I have no faith that my claim will be honoured but I want to fulfil my side of the contract so....
My contract with orange was taken out in October, 1st Bill recieved in November so when do I send my 1st claim in (18 month contract). They state send the 1st to 7th bills so that would be the end of May even if the contract is been running for 8 months? A daft question but it would be nice if someone could clarify when to send in my claim.
You send the first 7 bills. The first bill you have should be after the first few days of registration, so is not actually after one month.
Thus the 7th bill that arrives will usually be 6 and a bit months after you joined.
So you must have taken your contract out in late October, thus you 1st bill being early November.

I took out a mobile phone contract with Mobile Rainbow purely because this site recommended them.
They are very bad at paying out the cashback as i discovered on the first one I applied for. My bills were returned on time but the cashback wasn't forthcoming. I contacted them several times over the next 6 weeks and was fed a catalogue of excuses ranging from, we don't have your bank details to the cheque has been sent, the cheque isn't signed and wasn't sent it will be sent out in the next 10days. I waited and waited, finally I wrote them a letter saying they were in breach of contract and the money ought to be paid within 7 days or I would report them to the DTI. The cheque arrived the very same week. No letter or even a compliment slip, just the cheque in a scrawny old envelope.
If they are so begrudging at paying out cashback they really should not advertise it in their contracts.
By all means take out a contract but be prepared to stick to the T&Cs and when chasing for cashback just send them a short note - don't bother phoning their call centre in India, you'll be told a sack of excuses and you'll be charged for the pleasure!
There phone centre is rubbish. They often don't answer for ages! I was on the hold today, it finally rang through, and they cut me off!! That's sure one way of reducing the number of people in the queue.
Also, FYI, you don't have to call the 0870 number at all!

Hi guys, been a reader of this site, but only joined the forum today.
I have been chasing Mob Rainbow for my 2nd cashback (1st CB arrived, surprisingy, with no hitches).
It's been over a month since they had my claim. After reading other posters I sent them an email earlier this week saying, in summary, 'pay me or I'll take you to the small claims court'.
They haven't replied to the email (do they ever?), andas described above I've tried to call but can never get through.
Should I post the threat to go to court or is email sufficient, or does it not matter? Also in my email I said "I give you 7 days". Is that enough, or do I need to give them more?
I am on the old T&Cs, which say they will pay within 30 days by BACS. It has been 40 days now. Am thinking I've had enough and am going to court, should I give them more time, or the fact they have failed their side of the contract is enough surely?0 -
send recorded delivery letter and email giving them 7 days if still no payment take them to court for all of cashback 6th and 9th and 12th what ever they owe you, is what i did and i got the lot after they recieved the court action.0

So sending a letter is quite key?
I've never been sure, I've always thought that with an email at least you have a record of what you sent and when you sent it.
With a letter all you have is when you sent it!
I'll go with the letter too, I suppose there's nothing wrong with the belt AND braces approach!0 -
Hi everyone,
after taking MR (Mobile Rainbow) to court and claming full 18 months Cash Back, I received an email from them saying that they will pay but only the first Cash Back part (after 6 months) + expenses into my bank account.
Shall I accept that part payment or return the money? (as it could be considered accepted)
And what shall I do next if I want all claim to be paid this time.
I would appreciate your advice on what to do next.

I would push harder, you've gone to all this trouble of paying for the claims procedure, and you will probably have to do the same when the next ones are actually due.

What I am looking for is what further steps, including legal I should take to 'push harder' as I have no experience in leagal matters.

Hi everyone,
My first cashback was due about 60 days ago and I had posted all original bills -(1st month-6th month) along with the cashback form and a note and send it by special delivery and have proof that they have received it ontime within 30 days as my contract states.
I didnt get any response from Mobile Rainbow and their phone lines never get thro' the queue and I am sick of spending my time and money on failed attempts to get thro' to them...
Anyway, I wrote to them and didnt get any response either. Last week I warned them that I would take them to court and I demanded my cash back within 3 working days and finally they wrote to me saying that I am not eligible for my cash back as I sent only my 6th bill and havent sent it within the 15days time limit.
I am so annoyed that they are disgracefully lying to the customers....which is nothing but outrightly cheating the customer.
Luckily for me I have a proof that I have sent all the 6 months bills. (If they notice carefully on the 6th bill they'll know what I mean....)
So I have written to them again saying that I will take them to the court and mentioned about the t&cs in my contract (30 days)....
Now, i want to know how to take them to the court. I am newbie here and not familiar with the laws and legal procedures....so any help and advice would be really great.....
If I want to complain about them....should I be speaking to Office of FairTrading???/ should I be taking it to any other bodies???
Please advise!!!
OMG, this is so stressfull and bugs me especially when I have done everything as stated and they cheating on me......frauds....I don't know how these companies exist....
If lots of customers with proof prove their wrongs, could we put an end to their business>??? I mean their cheating....

simple online submission of your case for the small claims court - single submission fee which you can add to yoru claim - no need to get a lawyer - you can represent yourself.
I'm glad that I put all new retailers of dubious parentage into a lengthy quarantine period while waiting for a pattern of positive looking evidence to emerge about their intentions to pay out on their cashback promises - if it wasn't for this basic rule of thumb, MSols companies would have featured on my site a long time ago. As it is, I'm keeping my 10ft bargepole handy.
