    The King
I posted all mine by special delivery - when writing/complaining I quoted the days of receipt as per screen prints of the Royal Mail site. Didn't actually get to producing them (or any paperwork) though. Remember they may read this site.........

I thought as much, shouldn't have been so trusting I suppose.

For those who have pursued them via the small claims court, prior to pusuing, have you always handed over your royal mail delivery number to MR? Or is it possible to claim without having done this?

    Mozzer, tisme, blaster ???

when i sent my letter telling them i was giving notice to court action, i sent print off royal mail track & trace, showing that my cashback had been delivered by that date and i had been waiting 50 days for my cashback, to be honest they didnt react at all to this letter so i just went for court action on the day i told them they had to pay me by, so if you dont have your recored delivery slip then its upto you if you rsik it, if it goes to court i would think you need to prove that mobile outlet recieved your claim.

Well I didn't say anything in my claim about having sent in my claims by recorded delivery. They paid straight away. It depends if you want to risk the £30 to submit the claim. If they do defend it thinking that you won't be able to produce evidence then I think you can just withdraw the claim (obviously losing your £30). That said it wouldn't suprise me if they just paid it straight away without even checking. They are pretty crap to be fair.

    Hi,
I have always told them in my telephone calls and e-mails to them that I have had it verified by Royal Mail and they have never asked for the number to check but I have copies of all relevant paperwork needed to go to court.
They will not pay if they can get away with it.
For all those who are willing and able to take them to court there must be a whole lot more that don't or won't do it. This is the percentage game that Mobile Rainbow and other companies are playing.
    Good luck

Be patient, the court will contact you and tell you that they have to reply by a certain date, they(Mobile Rainbow) will leave it as late as possible to do anything. I would advise you to read the money claim online claimant user guide, it is very informative.

I have no faith that my claim will be honoured but I want to fulfil my side of the contract so....

My contract with orange was taken out in October, 1st Bill recieved in November so when do I send my 1st claim in (18 month contract). They state send the 1st to 7th bills so that would be the end of May even if the contract is been running for 8 months? A daft question but it would be nice if someone could clarify when to send in my claim.
  • I took out a mobile phone contract with Mobile Rainbow purely because this site recommended them.

They are very bad at paying out the cashback as i discovered on the first one I applied for. My bills were returned on time but the cashback wasn't forthcoming. I contacted them several times over the next 6 weeks and was fed a catalogue of excuses ranging from, we don't have your bank details to the cheque has been sent, the cheque isn't signed and wasn't sent it will be sent out in the next 10days. I waited and waited, finally I wrote them a letter saying they were in breach of contract and the money ought to be paid within 7 days or I would report them to the DTI. The cheque arrived the very same week. No letter or even a compliment slip, just the cheque in a scrawny old envelope.

If they are so begrudging at paying out cashback they really should not advertise it in their contracts.

By all means take out a contract but be prepared to stick to the T&Cs and when chasing for cashback just send them a short note - don't bother phoning their call centre in India, you'll be told a sack of excuses and you'll be charged for the pleasure!
