wow, quite a roller-coaster ride for blaster99999, mozzer and others who went through with the court claims. Salute to ya'll, and thanks for letting us know of your progress.

Ok so I sent my first cashback claim on the 22nd of Jan (with recorded delivery) and checked online that it arrived on the 27th of Jan, but then I never received any calls of anything from MR.

So I read through this thread cos I'm getting worried now (a bit late, but was way too busy during term time at uni to try and do anything), and just gave MR a call and after the Nth call I got an answer. After confirming my details they told me they had been trying to contact me to verify my bank details but weren't successful  so I confirmed my bank details and the lady told me I should receive my cashback in April ... and strangely enough she told me to check back with them in the first or second week of April about the cashback status (donno why).

Anyway I guess I should sit tight and wait for it, and then if I still don't get it by mid-April send the "letter before action" that mozzer pasted, before trying court action. So is this the best action to take atm?

    Hi all

I have had such a nightmare with this company, my year is up and as my hubby and I have 3 phones, we were due a total of 9 cashbacks, and have received only 4.

We are still waiting 78 days after our last ones were due, and we now only have 10 days until our next ones become overdue.

I have downloaded forms for the Scottish claims court, but wonder if anyone else in Scotland has used this method of claiming and how they got on. Did the guys from mobile rainbow travel up to defend?

We are off to Carphone Warehouse for our next phones!

    Thanks for your help

sorry meant to add transcript from their email
[Please accept our sincere apologies for the inconvenience caused to you.

We are writing just to assure you that prompt action has been taken in regards to your cash back situation. Your cash back request has been forwarded to concerned department on priority basis. Therefore, you can expect your cash back amount to be paid within 20 to 25 working days.

Once again, the inconvenience is deeply regretted.

    /QUOTE]

This would mean that the ones due in December would be up to 113 days overdue!

I reckon this company's bank account could be all but empty, hence giving myself and ultima a payment date in April.

Good luck everybody with your cashbacks

    Crikey!

If this is meant to be priority, I dread to think how long they expect everyone else to wait then!!!

For anyone wishing to contact me privately to ask me a question, can I ask that you email me directly as my PM box is often full.
  • Be warned dont mess about with this company , dont let them get away without paying you, when your payment is due contact them by phone and email them you have proof you contacted them then, wait 7 days and if still nothing phone again but also send email and recorded delivey letter giving them 7 days to pay there over due cashback and also state they have breaced there contract, because dependant on when you took out your contract they should pay within 30 or 45 days from recieveing your paper work, in your email and letter give 7 days to pay up or because they have breached contract you feel the contract is void and expect full payment and go for all your unpaid cashback, i did and got the lot , stuff em i say.

Thanks for the advice Blaster99999, have already done this so hopefully we will get our money this week.

For anyone who has received their cashbacks by cheque - can you tell me who their bankers are? I think it might be Alliance and Leicester.

    many thanks

hi guys...i've just finished a year with Mobile Rainbow...

when i first ordered, there too was fradulent activity on my CC...thank goodness my credit limit is ~£500 only and the fraud was picked up really early

my first two cashbacks were relatively ok, they reached my bank acct about 10 days late

my last cashback was more of a nightmare....they lost my initial paperwork and thus i had to re-send a new claim....the money was paid out 2 weeks late (if you count the date of the duplicate claim as the first day)...but undoubtedly this would have been much much later if not for my constant hounding and threats of legal action.

i would say its been an ok cashback experience save for the last cashback....the good thing was, at the time of my purchase, Mobile Rainbow had still allowed online/x-copy bills to be used in claims and they only req'd 3 claims then

well, their T&Cs have vastly changed now and i've gone with CNM instead...to all those who are owed cashback big time, pls hound them relentlessly. like the post somewhere above said, its really unfair that we have are bound so tightly to the deadlines for claims but they get to take their time when paying out!

I think the court that it gets sent to is the court nearest to them. But don't worry they wouldn't dare defend it! Especially if you've got documentation to show they have ignored you. I applied through moneyclaim.gov.uk on Sunday. Will let you know what happens.............
  • ive just done another cashback but this time with phonebox direct will see how they perform, strict t and c's but all companies have tightened up now, you should get your money within a week now you have claimed with online court action good luck to all with rainbow direct cos you will need it with these robbing sods.

I was just filing the claim with HMCS Money claims online and, BIG SURPRISE, the postcode MSOLS use in their email is NOT recognised as a UK or Welsh Postcode. Be warned, there is one digit missing, the correct postcode is

    WD17 1NA

and NOT what they state on their email system.

Isnt that coincidence??? Ha bl ha!
