i would look into this a little more mate when did you take out your contract with mobile rainbow cos they used to be send bill 6 in on its own, they only changed there T&C's about last october i think regarding sending bills 1 2 3 4 5 and 6 all in, so i think you did has there original T&C's asked for, if you can get a copy of there T&C's that were in force when you took out the contract and can prove you are right, email them and tell them you are giving them 7 days to pay your cashback has you followed there T&C's that were in force when you started your contract and if they do not pay then you will proceed with online court action and claim all your cashback for the 12 months has they have breached there own T&C's, worth ago mate i did this when they had not paid my cash back within 30 i got the lot through court action.0

Does anyone have a copy of the original Terms and Conditions? I want to put in a claim against them but cannot find them

My first claim was up early this month so I sent all relevant documents "recorded and signed" to them. Followed up with email asking for confirmation if they have received claim and when payment will be made.
Took 4 working days till email was picked up and a further 2 working days for response:
your claim has not been received, please send proof of delivery.
Is that standard practise to scare customer off and has anyone got any experience how likely it is my claim will be paid (bear in mind I have got proof).
Any further advise?

If you read everything on this thread you will see they do not want to pay and court action is the only way they pay up (I am talking from personal expereince too). By asking them if they received it you probably just gave them an opportunity to say no. You can email them the proof of delivery if you want but I would give them notice at the same time that you will take them to small claims court for the whole 12 months cashback and if they dont pay up DO IT! Its the only way to get any money from Mobile Rainbow.0

yes i had to take court action agaist these muppets on my 2nd cashback claim, had been waiting over 2 months for it and srill messing me about, so did the online court action for both contracts i was owed on for the 9th and 12 month cashbacks claim just short of £500 and they settled within a few days, and paid the lot includung the court fees of £500

Before claiming through the Court you must issue a letter before action.
It will get you absolutely nowhere - however should the matter go to Court you need to show you tried to sort it out before resorting to Court.
A form of words follows:-

Re: Cashback unpaid – letter before action.
I refer to the agreement between us entered into in May 2006. This was for a mobile telephone number ************** on a T Mobile contract for 12 months.
I am disappointed that, despite correspondence and exchanges between us, aspects of this agreement remain unperformed by you. Below this letter I copy Web messages sent to you via your website and some notes that I made contemporaneously of the two conversations between us. The aspect of the performance that remains unfulfilled is as follows:
• Cash back of £216 – representing the first 6 months contract entered into with T Mobile. This was sent to you by special delivery, proof of receipt obtained from the Royal Mail. Dated 31/10/06.
• All aspects of the 10 conditions in your terms were met. The cash back was due 31/11/06. Despite the ‘promises’ this has NOT been paid to date.
Your non-performance of these aspects constitutes a breach of the agreement. Due to that non-performance I am entitled to terminate this agreement by giving reasonable notice. In this instance, this is two weeks and this I now give. I am also entitled to recover damages for your breaches and I am setting out these damages as follows:
• I am now entered into an agreement with T Mobile which will cost me a total of £432. This amount must be paid to T Mobile - an amount and contract which I would not have entered into were it not for your terms of business of cash back. Therefore the whole of the contract amount will be sought and the contract with T mobile ended and no further use of the phone made. The full contract amount of £432 will be sought.
Unless I receive your proposals for the prompt payment of these sums within 14 days of the date of this letter, I will assume that you are not interested in an amicable settlement of this dispute and will proceed to issue a Claim Form in the Small Claims Court without further notice to you. This will involve a claim for damages, costs and interest.
I look forward to hearing from you as a matter of urgency.0 -
Hi, after a lot of hassle I have today been told by Mobile Rainbow that my cashback claim for our 4 phone contracts has been verified and accepted and is now with their accounting dept. We are awaiting our 1st cashback at 6 months on our 12 month contracts on O2

I'll put money on it ( not cashback) that you will next have a technical fault..............and a 14 day delay........then nothing.....0
