Do they not have to say on what grounds they are defending the claim?
On the MoneyClaim.gov website it just says "defence entered" so I think it now goes to a real court rather than a virtual court.
Can someone correct me if i am wrong?
  • ive read up on the .gov site and you will get something thru the post, i believe it will be the defence sheet from msols also i think next it goes to court, there's a help desk phone number for you to ring to ask questions
  • They defended mine too on the grounds that they had paid it already....letter came through the post and by the time it turned up they had paid the cash. Bottom line is I need to send them a copy back saying that I accept this and it should all complete. If they hadn't paid though I guess it would have gone to court.

Chief_Sam, read your msg, my advice is cancel quick. I am surprised you have had trouble with OSPS, I've never had a problem with either them or e2Save but MSOLS are cowboys, the only way to get money out of them at the moment it would seem is to take them to court.

They never respond to email and rarely do what they say they are going to do if you do manage to speak to someone on the phone.

I am also highly suspicious of what they do with your credit card details...I had fraudulent activity on mine just after I bought my phone from them...it may not have been them (possibly just a call centre scam) but its made me a lot more careful and others have also reported the same suspicions.
  • Trouble is, they paid my cashback at the same time as I filed the complaint. I still think they should have to pay my £30 court fees as I was forced to take them to court in the first place. The fact they happened to pay at the very last second is just a coincidence.
  • Mobile Rainbow have not honoured my first 6 months cashback because I didn't send all the pages of every bill I had received before 6 months. I did exactly what was written on the 'cash back policy explained' sheet sent with my phone which mentioned nothing about sending every bill in before the date.

When I rang them the operator I spoke to said that it was in the terms and conditions sent to me however I was never sent any T and C, just this sheet. I told him that I had done exactly what it said on the cashback sheet and he made me read out what it said twice! He then said that I may get my cashback if I sent in the sheet highlighting the part that 'misled' me.

I am not holding out much hope of receiving any money from them for that period and I am dissapointed that they made the cashback claims so murky and I will not be using them again. I hope anyone else thinking of taking a contract out with them will learn from my mistakes and ensure that they do everything to the letter or don't touch them with a barge pole!

PS I had 'unexplained activity' on my card a few months after signing up to MR too. May be a coincidence but........
Thanks to all who post comps :D

You could just lick your wounds or you could: https://www.moneyclaim.gov.uk/csmco2/index.jsp. ;)
Toyota - 'Always a better way', avoid buying Toyota.
  • You have the paper that says you only need to send in the latest bill, that's enough - you've done nothing wrong and you should get your cashback. Either through them or by using moneyclaim.gov.uk.

So, now my contract is coming to an end - is there cashback company that people *do* recommend? I was ok with OneStopPhoneShop but not sure if I want to use them again. CarphoneWarehouse are meant to be reliable but their deals aren't that great, anyone else?

what you could do with is a print of the T&C's when you took out the contract , no good looking at the ones on there site now cos they been changed, i noticed this change about 3 months ago and started to follow the new t&c's just to be on the safe side, i was just suppose to send 9th bill off copy will do but i followed new tc's and sent 7 8 and 9th originals off they couldnt pull me either way cos i had complided with both tc's one's when i took out contract and the new one's on there site now. They have also changed therepayout from 30 to 45 days from them recieving your paper work. Im looking round for another 2 cash back deals and will read all the tc's and print them out next time just to be on the safe side and recommend everyone follows same idea.
  • I looked through all the papers I received from them, I didn't get any T+Cs besides ones regarding Insurance.

I have the paper explaining the Cashback deal though which clearly states that I must send in the entire of my latest bill, and they'll refund within 30 days.
