    my main issue is that they are just stalling because they already have that information as I pay by direct debit.

    It could be argued that they are being thorough as your DD is with the network provider and hence you could change the bank without MR knowing.... but given MR's apparent history it shows willing on their part whilst they could be stalling further :)

    BACS should be with you within four working days....

  • When I claimed my 1st cashback (which took 10 weeks to arrive) They phoned me 3 times over 2 weeks to check my details. I got them to read them back to me (which they shouldn't do. I could be anyone) and then they paid me by cheque. Brilliant...............

    No payment received, so I have today filed a claim online for all our cashback claims and stress damages and costs.
    The ball is now in their court (no pun intended) so I'll keep you posted.

    Do you think they get a lot of people threatening court action that don't do it?

    Otherwise, surely they would take such threats more seriously; I've not heard about them winning any claim against them.

    I think you're right, many will shy away from Court action, as they don't know how simple it is. So it must be worth their while only paying when a court claim arrives. I sent letters to Directors home addresses etc and that had no effect.

    To assist in how it works =
    They deny the claim - then pay up. This way they keep a clean record.

    The Court sends you papers with their 'defence'. The Defence does not address the main point of why no payment. Also part of that defence is that they have paid. You check your bank and they have paid!

    Therefore you drop the claim as you have been paid (they pay the Court fee and postage etc) - and they can correctly claim no bad record at the small claims court.

    So don't be upset when you see at the Court online that the claim has been denied. I inwardly groaned and got ready to physically go to Court in Northampton, MR's home Court address (I think it was).

    But I'm sure you will get the cash before you receive the actual 'defence' papers.

    so...effectively can you just ignore their "defence" and just enjoy the money that's in your bank acct?

    Not quite......you have to reply to the Court (copy to M Rainbow) that you no longer wish to proceed (tick a box on an accompanying short form). That's the end of it.
    Otherwise you could end up going to court to withdraw and could have to pay MR's expenses.

    Thanks grayme-m and mozzer, also thanks to all who contribute to this forum.
    I agree with you both, a lot of people threaten and don't have the confidence to go through with the court action, either because they think the threat of court action is enough to get them their money or they think it is a difficult process.
    Having just completed it yesterday the main thing is to try and emphasise that you have done everything that is required of you to comply with the terms and conditions and Mobile Rainbow have breached their contact/terms and conditions in not paying or delaying payment.
    This must be done in a maximum of 1080 characters (including spaces) and a maximum of 24 lines. I used up 1080 characters but found that I had used 29 lines so had to edit it to fit, reducing it to 975 characters in 24 lines.
    That said, I had the confidence to do it because after reading this forum I knew I wasn't alone and that inspires you to do it.
    Thanks again to all of you and I will let you know the outcome probably next week.
