Thanks a lot Reestit, it's a great relief to know that I dont need a lawyer....and it's all such a hassle....
Ok, I will do so....I had given them 3 working days notice to deal with my claim and only 1 day is gone...I'll wait until wednesday and then submit my claim.
It's a great idea to create this statistics and bring together the problems so that other customers will learn from our experiences....also, together, we can learn/change things....or atleast try to...

I have another question.....
If the Mobile Rainbow claims that they received only my 6th bill whereas I have sent all the relevant airtime bills in original(1st month - 6th month), can I/court ask them to submit the bill that they received. Will they still have it and would they have to produce it to the court if asked for??
Has anyone had similar experience where they have disputed the contents of the package??? I hope they don't think we are idiots when they tell us that they received only the 6th bill while we have personally put in all the 6 bills together in the envelope???

when i was misfortunate to be a mobile rainbow customer and chasing for cashback last year, this is what i did when sending off a claim to them. Send in all original bills upto and including the one they want so i was asked to submit bill 4 but i sent bill 1 2 3 and 4, with a cover letter explaining there cashback requirments and sent all recorded delivery, i photo copied everything i put in the envolope and kept all this with my recorded delivery slip, i then gave it a week and checked on post office track and trace and checked that it had arrived, then phoned or tried too get thru on phone to check it had arrived, i wrote down every step i did including ppl i talked to and kept all in a file, my first claim took 50 days for them to pay into my bank. Ifollowed the same proceedure for my second claim and after i had been waiting for 40 days (u have to wait 45 under new T & C's ) and should have been paid within 30 days, i phoned and was told i would get paid with in next 10 days, so i emailed and sent a letter giving them 10 days to pay or legal action would follow, i recieved nothing from them so proceeded with a online court action claim has i had been waiting over 50 days and had nothing from them, i claimed all future cashbacks aswell has they had breeched there T&C's and got all my money from them on 2 cashback deals nearly £500, i also did this for my brother too and he got is money, so if you have all your proof go online court, you have to be seen by a court to be giving them a opotunity to pay, so thats the reson you need to contact them and i did this by phone email and recorded letter.0

Yes, I did exactly the same...I had photocopied every single bill for the last 6 months and sent all the 6 months originals to them via special delivery (next day) and confirmed from postoffice trackntrace that they had received it. It was sent on 9th February and till today didn't get my cashback.
I had telephoned them in vain, emails but absolutely no use...just waste of time....so after reading some of your advice, I had threatened to take them to court, last week by email and then I was told that I was not eligible for cash back as they had received only the 6th bill and after 15days cashback period.
I have sent all the 6 bills and it can be proved if they are asked to show the 6th bill that they claim was the only one they received as I had written clearly on that I am enclosing all the 6 bills...
Fortunately, I have my terms & conditions safe along with the photocopies of all the bills and the special delivery receipt.
So, when i wrote to them that I was going to prove my claim and see them in court etc. etc., and would make a complaint to the Office of Fair Trading, today they had emailed me to fax them the terms and conditions i have.
God, they should know which customer had taken the contract, when and the t&cs applied to them....
Anyway, im gonna fax it today and email them that if I am not promised cashback in written by return fax....i would be suing them by end of the day today...
I will keep you guys updated...thanks again for your suggestions and advice...

Any ideas how soon the claim will be sent to Mobile Rainbow? Applied last night so the courts would have it first thing this morning.0 -
I'm in the same boat as several others here, in that I've received two of my cashback claims (second one was VERY late) but no sign of the third. Although that's the final cashback I'm still down £142.50 and I'm not prepared to let it go. I followed all the T & C to the letter. I've given them several chances to rectify the situation and haven't had so much as a reply.
I was going to claim on moneyclaim.gov.uk but that site cannot be used unless you have an address in England or Wales -- I am in Scotland so it looks like I'm left doing it the old fashioned way.
Has anyone who lives in Scotland claimed against a company based in England, and if so can you offer any advice?
I recommend this company are avoided like the plague, nothing but hassle. :mad:

I would refuse the money and carry on with the court case. They have breached the contract so will have to pay. When I claimed against them in court they still owed me 2 cashbacks. I certainly would not have taken an offer like that. Trust me they will only do it again.0 -

They transfered the first cash-back part onto my account and later emailed me about it. So how (which way) do I refuse the money?0 -
There is no need to refuse the money.
You have submitted a claim, which they have part paid.
When the time allowed for them to dispute your claim has expired you should request judgement from the court in respect of the amount still outstanding.0
