isa wrote:Hi, a friend of mine is currently claiming from Capital One credit card, she's only sent the first letter so far.
They've just written to her saying that they're willing to give her back the difference between what she was charged and £12, which is their new charge level.
This would be £64 back from £200.
Can anyone advise? Should she continue & send LBA? Are they just trying to wriggle out or can they do this now?

hi there all
sent my first letter to abbey two weeks ago with a £10 cheque, recieved a reply today.thanking me for the letter plus a form to fill in which i am to send back to them with a cheque for the sum of £10. i contacted the bank and informed them that i had sent the £10 to them with the original letter. the reply i had from the bank was they had no knowledge of any cheque sent with the letter and it must have got lost in the post, the strange thing about it was the cheque was stapled to the original letter, so how did they get the letter but not the cheque??????????????0 -

Yes.
Don't send copies of statements highlighted as you may/will need a list with dates and descriptions should you file your case at court as this list forms part of your defence. Always remember to make several copies0 -
Hello,
I received a reply from HSBC on 27th Feb to my intial demand stating
I am looking into the matters you have raised and I will contact you with a full response as soon as I have completed my investigations
How long do you think I should wait to contact them again and has anyone received a similar letter and what did you do/what was the final outcome.
Many Thanks0 -
Bank: First Direct
Amount Claimed : £1496
Amount Received : £1210
Sent off template letter no.1 with summary of charges taken from on-line statements (took about 30 mins). Got a reply within 10 days offering £1210! Easy peesey and frankly I'm really chuffed with this so will not be chasing the difference. A huge thanks to Martin and the team. I'd love to buy you all a beer. :beer:0 -
Bank: Natwest
Amount reclaimed: £6,700ish + interest and costs
Amount repaid: £8,000
Whoop whoop whoop.
Arrived home today to find I'd missed a special delivery. Went to Post Office to find letter from Cobbetts and a cheque for £8,070.60 along with the usual "goodwill" rubbish and no admittance of fault.
We were due at court on March 23 so I am well chufed. Took about eight months from start to finish and there were times when I was so tempted to give up, particularly when they offered £2,500.
It's a long and at times scary process but I will now be debt free and have a brand new 37 inch LCD television within a matter of days!
Life is good again and I can't thank all the people who offered moral support and helped out enough.

I started the ball rolling with regards to claiming back my bank charges at the end of January from HSBC.
I recieved a reply saying that it could take up to 8 weeks to investigate.
Up until now I hadn't heard a thing, so 2 days ago I sent them another letter complaining of the lack of response.
iIrecieved a letter today saying that they appologise for the delay, appreciate my patience and they will contact me again by 3rd April with a full response.
By this time the OFT would have made their announcement. Will this make a difference? If they refuse then it will mean taking them to court after the decision has been announced.

I too have started the ball rolling, but with the Abbey. I downloaded the templates (thankyou Martins Moneytips for those) sent them off, got my statements, worked out the charges and sent off my claim. Abbey responded with standard letter explaining complaints procedure etc. I followed up with a threat of court action if I had not heard within 14 days. They replied with an apologetic letter stating the investigation was taking longer than expected and they will write again in 4 weeks. Do I ignore and pursue through the courts or are they playing for time with the impending OFT ruling? Somebody please advise0 -

Your first letter will have given them 14 days to respond. After 14 days you should send your LBA 7 day letter - particularly since they are suggesting it will take them some weeks to investigate your claim. - Use YOUR timescales...Lou0 -
