financiallychallenged wrote:I too have started the ball rolling, but with the Abbey. I downloaded the templates (thankyou Martins Moneytips for those) sent them off, got my statements, worked out the charges and sent off my claim. Abbey responded with standard letter explaining complaints procedure etc. I followed up with a threat of court action if I had not heard within 14 days. They replied with an apologetic letter stating the investigation was taking longer than expected and they will write again in 4 weeks. Do I ignore and pursue through the courts or are they playing for time with the impending OFT ruling? Somebody please advise
This is their standard letter so its up to you if you want to phone them and chase it up or start a court action.0 -

Hello,
I received a reply from HSBC on 27th Feb to my intial demand stating
I am looking into the matters you have raised and I will contact you with a full response as soon as I have completed my investigations
How long do you think I should wait to contact them again and has anyone received a similar letter and what did you do/what was the final outcome.
Many Thanks
I started my claim with HSBC 17/01/07 and they replied with a letter and a leaflet of how to complain!
I then sent the 2nd letter, heard nothing, so I rang and gave them the opportunity to discuss the issue.
However, HSBC are taking about 8 weeks to deal with each claim they are receiving, but they were very polite and said if i wanted to wait a few weeks I would get an offer. I did'n wait, I carried on! So, send the 2nd letter after 14 days, etc. I am now a few days of judgement at court and I have received an offer this week. I am not accepting it.
But, If you want to wait about 8 weeks, they will make you an offer.
They don't pay the interest either. So if your claiming that you will not get it unless you go through the court process.
Its your choice.

Claimed £60
Offered £60
Sent letter asking for £60 charges back on 28 Feb, offer letter dated 5 March. Phoned on receipt with bank details, and it was being transferred as I spoke to them.
MoamAlthough no one can go back and make a brand new start, anyone can start from now and make a brand new ending.... life is a WIP.

Hi All,
Bank: Intelligent Finance (court action against Halifax Plc)
Amount claimed: £707-53
Amount paid: £707-53
Brief story:
IF were adamant they weren't going to pay. I submitted my claim form and on day 12 (of the 14 days they had to defend or settle) they sent me a letter offering to settle the claim in full. They said that they would do this by paying it in to my account. I sent a fax back saying that as I didn't have a current account with them anymore, I would only stop the action when I was in receipt of a cheque or an electronic transfer had taken place. They sent me a cheque by first class post. They didn't check their records to see that I still owed them a small amount on my credit card.
THANK YOU MARTIN FOR THIS SITE - IT HAS HELPED MY ENORMOUSLY.0 -

I HAVE BEEN THROUGH ALL OF THE SET OUT PROCEDURE. THE BANK PROVIDED A DEFENCE CLAIMING THE CHARGES WERE SET OUT AND THAT I HAD CLAIMED PRIOR TO THE 6 YEAR CUT OFF. I AM NOW GOING TO COURT AT THE END OF THIS MONTH AGAINST LLOYDS TSB. I AM TRYING TO RECLAIM £4.500 IN UNFAIR CHARGES. I RECIEVED THE COURT ALLOCATION QUESTIONAIRE AND HAD TO PAY AN ADDITIONAL £100.00. A BIT WORRIED ABOUT THE COURT PROCEEDINGS. HAS ANY BODY LOST IN COURT AND IF SO WHAT WAS THE REASON???  :eek:0
