we have the same problem. co operative bank will open you a cashminder account which gives you a visa electron debit card and the facility to set up direct debits, standing orders and online banking. hope this helps0

Going through the motions of claiming back from Alliance and Leicester. Sent them the 2nd letter late last month and had their reply. Checked my online banking and they have refunded me...
68p!!!
Is this just a 'goodwill' gesture?? Is it time to start court proceedings?

It has gone better than hoped. I sent Abbey the initial letter, had a reply saying it would take a month to investigate, then a letter today saying sorry but it will take another month. Checked my account just now, though, and they have reimbursed in full the last 15 months of charges (£260). I can onlt assume the rest will follow in time.
This was despite being overdrawn £450 and being on Incapacity Benefit, with no obvious way of carrying out my threat of taking them to court. As a qualified (but non-practising Journo) in my head I was planning a letter writing campaign with which to threaten them, but no need.

thanks to martin and everyone who posts support on this site, it was so easy didnt even have to threaten with court - which was a shame cos i was looking forward to that!!! they offered the without interest sum and i accepted! will pay for a mini break for me and the other half. would recommend all natwets customers do this - they almost expect it!!!)

The story: It was sooooo simple! I wrote the first letter off to them with a breakdown of all the charges i had accumulated, sent it off, had a letter back within 14 days stating it would be looked into, then, after a further 10 days had a letter and an acceptance document for me to sign saying that i'd accept the offer, and it was then put into my account. i have managed to get a list of all charges for the last 5 years by joining online banking with Lloyds tsb i have waited since the 12th feb but have not heard anything so thought this may be quicker...
right i have the lists but how do i set it out on paper wot info do the banks want is it set out
Date of charge..... what the charge was for.... the amount.....???

I'm happy to say that I have today received £135.00 back from Cahoot, following on from the first letter I have sent to them regarding these charges.
However, the e-mail I have received from them is quite clear that they do not believe the charges are unlawful:
'We do not accept that the cases that you mention apply in this situation or that cahoot charges are unfair under the Unfair Terms in Consumer Contracts Regulations 1999. The object of these Regulations was not price control nor were they intended to interfere with people's freedom to agree the terms of their contracts.
It is well known that banks make charges and cahoot charges are in line with those of other banks. The terms and conditions of the account and the charges that apply are clear and fair and were provided to you at the time you opened it. You freely agreed to the terms and conditions and the charges when you opened the account. You were not under any obligation to do so and could have gone to another bank if you did not agree to the charges. Equally, you are free to move your account to another bank at any time if you do not agree with the charges.
In any event, we do not agree that the charges are disproportionate. The charges are reasonable and proportionate to the administrative costs incurred by cahoot'.
They finish the e-mail by offering the full amount back on the basis that the charges concerned were 'uncharacteristic breaches of the terms and conditions'. I had already e-mailed them months ago to point out these events were one-offs but had no joy at that time!
A little bit of a snooty response, but I have what I want! Oh, and for those wondering they have not threatened to close the account - yet!0 -

Ohmigod! We can all go home now! What are you going to spend it on? Don't spend it all in one shop. That is hilarious and i don't think it should be construed as a goodwill gesture. You could ring them and ask if they've made an error, casually mentioning that you're ready to issue court proceedings... Good luck, LouLou0
