  • Are small businesses entitled to claim for unfair bank charges. My husband & I were in business together during 1990 - 2004, although now he is a sole trader I wondered if we were still able to claim the horrific bank charges put on us during 2000-2002 and before I start the search for bank statements etc I would like to now if we can still claim or is it only individuals that are able to reclaim. Sorry if this is in the wrong place but am new to this game !!

    You can but only going back six years from when you contact the bank for your info/statements. Have a read of this thread...

    He can complain to the Information Commission if he doesn't get his statements in the 40 day time limit. The banks won't be lying they are just trying to deal with these quickly with what seems a good offer but only you can decide that.

    The proof of delivery presumably is when it was signed for but they are saying the department dealing with it received it on a different date which would be the time it would take I assume.

    I would wait until Monday now for the LBA.

    The banks will check the claims and that is why they do have to be accurate. You can refuse the offer and take it to court but obviously this will take longer to get the money,have a look at the First Direct thread to see how other users are getting on with them but in the end the decision is yours to accept or refuse.

    I have gone through Martins step by step guide as i am trying to reclaim £2400 back from Natwest plus £120 court costs. I received an offer from them offering me £1800 and to be honest i would of accepted this , but it came the day before they were served with the court papers and as it was a saturday i couldnt cancel it so i thought why not go all the way?
    i am now at the stage where the have aknowledged the claim and have now a further 14 days to form a defence. I will admit i am getting a bit worried now and wondering whether i should give them a call or should i just stick it out? I think from reading the offer i have 8 weeks to reply or i may of read that wrong? I see lots of people have had lots of offers but i have only had the one!
    Could do with some advice from people who have been in this waiting game.
    You just have to wait to see if they enter a defence in which case you will get an Allocation Questionnaire to fill in. Have a read of the NatWest thread to see how other users are getting on.

    Whilst I fully support and agree with the principle of reclaiming unfair charges, I wonder when one of the banks will get around to using that act as a defence?

    Failing that, why is the OFT recommending that bank charges for withdrawals; direct debits and standing orders be considered as a fairer way forward? I can remember Lloyds (before TSB) in the 70's charging for every action on my account and the monthly statement listed the costs. Surely we don't want to go back to that again, do we?



    The banking act is not the issue here!
    The issue is why £35 pound charges is deemed fair according to the banks when it is a automated process that should cost no more than £5 tops including envelope and postage.

    The Story:

    • I submitted first letter on 19th of January asking for £3511.76 (£2996.50+£515.26interest)
    • I received standard stalling letter on the 2nd of February “we are looking into it)
    • I submitted second letter on the 9th of February giving them 7days
    • I phoned them on 16th of February asking what stage we are at they said they would have it sorted this week.
    • Today I received offer letter saying interest is in not appropriate and the offer £2611 in full and final settlement.

    Mables cc requested charges
    Mint cc requested charges
    MBNA cc's requested charges
    Sainsburys cc requested charges

    I am not paying the £10 each time on the basis that there maybe no charges. i will only pay if the request it.

    Girlfriend
    HSBC claimed £1295.23+interest still outstanding
    Capital one cc requested charges
    Alliance and Leicester requested charges

    Mate
    Capital one claimed £440+interest he accepted £150 goodwill

    Hi

    THank you for your help so far, I have one more query though. I sent my initial letter to the address supplied in the addresses thread (address supplied : Penny Berryman,Senior Manager,Data Protection Dept,Lloyds TSB Bank PLC,The Pentagon,48, Chiswell Street,London ,EC1Y 4XX).

    I telephoned this dept on Tuesday, only to be told that this was the wrong dept in which to send my letter to! Is this still the correct address despite what I was told?I'm more inclined to believe Martin and his helpers than Lloyds! :confused:

    I will be sending afurther letter to Lloyds informing them that as I have not received my list of charges, I have no option butto report them to the Information Commissioner (scare tactics to get them to post them to me, as suggested by another helpful member), should I send this to the same above address that they told me was the incorrect one?

    Hi ya, does the 40 day time limit include weekends, or is it only work days monday to friday?
    My letter requesting the charges was recieved on 14/2 (electronc proof of delivery now available on royalmaols web site) & if the waiting period includes weekends, my date for the 40day time period is 26/3, if it's only monday to fridays, then it's 11/4. hopefully it includes weekends, bring it on !!
