  • I've searched through the threads but can't find anything to do with my query.. I don't even know if i'm starting a thread or replying to one as this will be my first thread (or not! newbie) so apologies..
    I am currently working on the second stage and have written for my charges (£1069) back. The HSBC Have said they are treating my letter as a complaint and therefore are entitled to 8 weeks to reply to me (this i have checked and is true) But my letter is not a complaint it is a request.. so should i stick to my 14 days guideline or accept their 8 week bull?

    Amount Claimed : £140
    Amount refunded : £140

    Easy Peasy! Contacted First Direct through my online account and asked for the charges I had taken over the past 2 years to be refunded to me. Threatened to take it to court. First Direct then contacted next day via email and 3 days later by letter for me to sign a disclaimer. Refunded back into my account within 5 days.:T

    8 Weeks is what you should give them if you want to take it to the FOS instead of the small claims court...The FOS can sort your claim out for free from what i've read on their website and what their rep said on watchdog on tuesday...but how much you get back and just how long it takes to get your money back after this time..i don't know? The court will see 4 weeks as long enough for your bank to pull their finger out (they will also have a futher 4ish weeks if they file a defence...loads of time) and will award the amount you ask for, plus interest.

    Can anybody help me? I bank with Natwest and have been trying to claim back just over 2k in charges from them, we have got as far as Natwest raising a defence and myself filling out the court allocation questionnaire!! Nat west are just not giving up!!

    I have received from the court a letter requesting further information and am just totally confused by it all now, the requests states

    Q 1. Account information - fine
    Q 2 . Charges information and dates - fine
    Q 3. The court says
    In relation to each charge, please clarify the following (a) is it the case of the Claimant the same should not have been charged? (b) If yes: please explain why the claimant contends that the same should not have been charged? (c) If no: is it the case of the claimant that the same should not have been charged in this amount (d) if yes: please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the claimant contends should have been charged. (e) If no: please state the Claimants case.

    They then go on to say that - In my claim I sate that the charges are in breech of the unfair terms in consumer contracts regulations 1999 (and) the unfair contract terms act 1977 - they then say

    Please specify all the facts relied on by the claimant in support of the contentions in paragraph 3 (question above), and in particular please identify (a) the section(s) of the unfair contract terms act 1977 (UTCA 1977) and (b) the regulations of the unfair contract terms in consumer regulations 1999 (the regulations) relied upon by the defendant in alleging that the contractual provision (s) referred to are unenforceable, Please also identify the contractual provision(s) that the claimant alleges are unenforceable by reference to UCTA/ the regulations


    WHAT!!! I have pretty much no idea what information to give them, has anybody had this and what did you write. A friend of mine went as far as court (and won) so I am fully expecting it to happen but and advise on what to send back to them first would be great!!

    The story:
    After seeing Martins articles and the BBC pages wrote and got statements. Identified the amount owed (£836) plus interest charges (£109). Wrote to MBNA saying that they owed me £945 including interest. Received reply denying any responsibility but offering £440 as goodwill gesture. Replied accepting amount as an interim payment and again saying that they still owed me £505. Did not get reply within 14days so filled out court papers on line. Within the week received another reply denying they were doing anything wrong but giving me £505 as another goodwill gesture.

    So I have received the full £945 (which includes interest).

    Now going for another goodwill gesture for the £50 court charges!

    If I can do it anyone can. Just take everything step by step and keep notes on what and when you do things.

    Don't know if i've come through to the right thread, 1st time user.
    Have sent 1st letter to Lloyds TSB (Customer services Dept). Have received a negative reply. Have read the faqs and it says to write to registered office or local bank. Do I send second letter back to customer services or to registered address? Also have gone back to May 2001 charges, is this too far?
    With regards to first letter I did not include interest, do I include it on the
    2nd letter? Am reading so much into all this that I am getting quite confused about it all.
  • where do i get the address for mint credit cards to get my statements not on list i dont think im putting my questions on right thread not brilliant on computers taking me forever to find my way around thanks .
