  • 13 days now since I sent off my letter detailing charges (sent registered post which arrived on the 8th Feb) and still not even any acknowledgement from them! roll on Friday and my LBA gets sent, then only 1 more week until I can start with the court proceedings! them being so lame has just added to my determination to get the money back. I would be quite pleased if it got to the stage where I had to get the bailiffs on them!

    Surprise, surprise I had a letter from the bank waiting for me when I got home yesterday spot on the 13th day although they claimed they received it on the 12th. After checking back on the letter I sent I have just realised I forgot to put the date on, can I send my LBA tomorrow now the 2 weeks I have specified is up or should I wait until 2 weeks from the 16th when they received it? I have proof of delivery that they received it on the 8th. Where do I stand?:confused:

    Tips on what to do next please. I am claiming approx £910 worth of charges on 2 cards. It would be interesting to know if anyone has had any joy getting Amex to cough up! ... Here's what Amex say:


    I refer to your letter concerning the default charges levied to your account.

    American Express maintains that our charges are fair and reasonable and are avoidable by complying with the t&c's of our agreement with you.

    In light og the OFT recommendation American Express has changed the charging policy with respect to default payments. Our charges vary according to product and account type and reflect the differing risks accociated with each. The changes were applicable from 1st July 2006 and our previous default charges will not be amended.

    We have informed the OFT that our default charges will be £8 on credit cards. This reflects the costs involved in administering accounts in default, and is calculated in accordance with the guidance issued by the OFT on how to calculate default charges.

    We have informed the OFT that our default charges will be £10 on charges cards. This reflects the costs involved in administering accounts in default, and is calculated in accordance with the guidance issued by the OFT in how to calculate default charges. This reflects an amount reflecting the additional cost to us of funding borrowing on the customer's behalf whilst they are in breach of their payment obligations. I trust this clarifies the situation"

    Don't know if i've come through to the right thread, 1st time user.
    Have sent 1st letter to Lloyds TSB (Customer services Dept). Have received a negative reply. Have read the faqs and it says to write to registered office or local bank. Do I send second letter back to customer services or to registered address? Also have gone back to May 2001 charges, is this too far?
    With regards to first letter I did not include interest, do I include it on the
    2nd letter? Am reading so much into all this that I am getting quite confused about it all.

    Reply to the address they sent the letter from. As you didn't include the interest on the first letter you need to leave it out unless your case goes to court and then the interest can be claimed, the bank won't include the interest in any offer they may make before the court stages.

    Bit of a tough deal I know but in the letter i recieved today they state i didnt take into consideration £52 refund they gave me a few years ago when i pleaded on the phone, they are also not taking into account the recall fees of £75 and claim i have a duplicate amount of £25 (which isnt true - they just charged me twice in one day).So the correct amount claimed should have been 783.79. Dont know whether to take the offer or not. Feeling a bit worried as i have an overdraft of £600 and i dont want them to close my account. :confused:

    Can i claim unfair bank charges even though i didn't have an overdraft facility in place halfway through my time being with my bank. I noted that one of the headings mentioned from Martin's link is if you go over your O/D facility you can claim. I have already submitted a claim to moneyclaim today, so I really need to make sure that I can claim with this in mind.

    I would appreciate a response from anyone asap possible as I am still in with a chance to claim my money back from moneyclaim if my suspicisions are correct.

    I have already filled in my QA and have written exactly the wording suggetsed on this web site. Should i just reiterate in this letter back to the court and say the same? They are just asking the same questions as already given aren't they?

  • i had a bank account a few years back which charged me hundreds of pounds in charges when i was going through a very sticky divorce i closed this account and dont have the account number now i have also remarried and have changed my name is ther anyway i can claim my charges back i am still at the same address if that helps thank you :mad:
