Allocations Questionnaire

I'm new to the forum and have searched but can't find any advice easily on how to complete the AQ specificaly sections c-g.
any help would be appreciated

    The above was very helpful but not getting any replies to questions I have asked. Basucly i followed info on the Banckchargeshell web site and didn't follow protocl. ie 1st and 2nd letter. Any way filed a mcoline form which surprise Abbey defended. What i want to know is it too late to claim back the last 6yrs charges or has that ship sailed. Also I have ticked the yes box on the section of the AQ that allows a mth for me to settled with Abbey. i am writing a letter based on 1st letter template and don't know if I should mention that i wish claim the last 6yrs.
    I wish i had gone to this website b4 as the bankchargeshell is not that helpful and the forum was down when i started this process.
  • In the process of cliaming £1.400 bank charges. Gone thro' small calims route and bank has now put in defence. Is there anyone out there who can help me with completing allocation questionnaire? The bank has listed 8 reasons for defence three of them are refering to civil procedure rules' one referes to the commercial agreement that was undertaken when I opened the account, one to me not maintaining the account in credit. Do I need to address each piont on the Allocation Q.? Will I have to attend a hearing?
    I feel out on a limb and am unsure whether or not to proceed. Please help.
    On a lighter note I have suceeded in getting £490 charges refunded by a credit card company which gave me the bottle to take on the bank.
  • I received a letter yesterday, Lloyds have decided to take this matter to court and I recieved a court allocation questionnaire, very nervous about taking this matter any further, will I have to go into court and give evidence? Any advice, or experiences would be much appreciated

    Don't worry too much. This is just the next stage of the court process. It is a relatively easy form to fill in. Plenty of people have had to do this, and the banks have still settled before the hearing date.

    Had my Allocation questionnaire form through for my lloyds claim, just really stuck on what to put in the other info section (G). had a look at the CAG suggestion is this sufficient? has anyone else used th CAG one? :confused:

  • Hi yeah I am stuck too on part G I am not thick by any means but this is all so overwhealming and I dont have a clue what to put as far as I can see the bit on the CAG web site does not apply to me as I am only claiming just short of £1000. Any ideas??
  • Afternoon - Ive had a good scout round to find the answers to this on this site and the consumer action group site as well, but with no joy. The situation is this. Ive paid my £30 fee online to the money claim online people, and the bank have filed a defence, and Ive now been sent an Allocation Questionaire

    Thanks to Maniac886 for the very usefull notes on filling out the Allocation Questionaire, but there are a few things still unresolved.

    Firstly, does anyone have a template/ rough idea of what to put in seciton G? This is the area where you put in brief any info you think might help the judge. I got from Maniac886 notes that I must put in about requesting standard disclosure, as that is what the banks do not want to put in, but Im thinking that there must be more I can add to bolster my case without waffling about how its 'just not fair'.

    Secondly, Section I, regarding the Fee. It says 'Have you attached the fee for filing this allocation questionaire?' Is that the £30 that I have already paid online? Or do I have to pay another fee for this specific document? My concern is that in the notes it says if 'you do not pay this fee it might lead to your claim being struck out'. Obviously that would be bad news.

    And Finally, does anyone know the location of info or threads of people that have been dragged to court, or what can I expect next?? This is a bit of a nervy period for me...

    Hello, for section G put this:


    I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

    However, the continuing problem is, (in common with the 100s of other cases currently being brought by other bank customers), that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

    Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. This would bring a rapid end, not only to this litigation, but would also likely bring an end to much of the litigation in progress against other high-street banks.

    Also in section G say you believe the case will last no longer than 1 hour.

    If your claim is under £1500 there are no fees to attach with the AQ. If you need any information about going to court, CAG forums will have more information regarding this.
