HI, I have just received today my Banks (Lloyds tsb ) defence statement along with an allocation questionaire, the courts have also stated that £100 pounds is payable on submitting this form, is all this standard? Has anyone out there been to court yet on a defended case got any advice, the bank by the way has already returned £750as a "gesture of good will" but is contesting the rest, approx £1400.0 -

also im !!!!!! myself about wot the banks solicitor has put in defence notes, its says "contention that the statement of claim is insufficientlly particularised and is embarrassing. the defendent reserves the right to plead further to the statement of claim once they are sufficiently particularised. the defendent will object that the particulars of the claim in this action disclose no reasonable cause of action against the defendant and makes no specific allegations against the defendant as to why the defendant should be liable to the claiment for the amount claimed. phewww theres more but i wont put anymore, so im wondering wot the hell should i do next? please please could someone help me??0

Received Cobbetts A.Q. this morning. Part G states pursuant to cpr part 3.4(2) (a) the defendant would ask the court to strike out the claim. the claiments have not shown that they have reasonable grounds for bringing the claim and, despite the defendant requesting that the claiment remedy the lack of particularity pleaded in the particulars of claim within 14 days, the claiments have failed to do so. The defendant therefore respectfully requests that the claim be struck out.
please somebody help as i would hate to loose at this stage0 -
Ady, You need to type out exactly what you put in your particulars of claim. If they are insufficient then you may need to formally amend your claim with an N244 application which will cost £35 which is non refundable. However some banks enter this defence whatever you have put to scare you and you may only require to send your schedule of charges claimed into the court and the defendant.Debt at lightbulb moment (June 2006) - £12984

This seems a bit standard for them. They asked the same for the Natwest case I was dealing with, even though I had provided more than enough details.
What did you put down for the particulars of claim, and did they write to you asking for more details on this?
Just wait for your AQ, and fill it in as advised in post #8 in THIS THREAD.
Dont worry too much. Even after sending similar to me, the bank still settled in full without taking the case any further.How many surrealists does it take to change a lightbulb?
