    Very straightforward, they sent my duplicate statements which I had to sift through and identify charges, once this was done, money was promptly credited to my account. Total process took 3 months.
  • I have received a letter and Defence from Nat West requesting further information - the reason being is that on the claim submitted online, there was not enough space to include everything needed to complete my claim. They now require a breakdown of each charge and the amount and reasons, they also want me to state why the charges are unenforceable by virtue of the Unfair Terms/UCTA 1977 plus identify the contractual provisions that I allege are unenforceable by reference to UCTA!

    My charges which I am claiming is £1720.

    Can anyone assist please?

    If you have taken Nationwide to court and won and they still haven't refunded the charges you complain again via MoneyClaim.

    There is a link in there to the FO complaints page, there is no template letter on MSE for complaining via the FO.

    No you can't claim interest on your overdraft.

    but you can claim back unauthorised overdraft interest , which would be around 2.1% a month or 27.9% a year .
    this is the interest that has accrued over your authorised overdraft limit .

    This can be a nightmare to work out , but I am currently working on a spreadsheet that will be able to calculate this according to your own banks rates.

    Send them a schedule of your charges throughout the period you are claiming. If you go to www.consumeractiongroup.co.uk they have all the templates there and show you how to work out the interest spreadsheets and will help you every step of the way with the right wording and what to send. You should really have sent two copies of this schedule to the courts immediately you had filed the MCOL. So if you do it now then they can see exactly where the charges are claimed from. HTH
  • This is the first time I have used this so I hope I am typing in the right place. I am currently in a reypayment plan with Payplan and as such have a whole heap of charges which I have incurred over the 6 year period. I dont bank with any of them any more, and the cards are obviously frozen/closed off. Can I still go after them or is it a bad idea ? Any advice greatly appreciated

    Very easy process if you follow Martins guide. Sent the first letter at the end of November to the HSBC based at Caboot Sq. No reply.

    Sent the second letter recroded delivery on 19th December. recieved reply on January 6th saying we are looking into your letter and will get back to you soon, no date given on when they'd reply.

    Today received the standard letter everybody is getting 'If it went to court we would win, they are fair charges, blah blah blah... but as a gesture of goodwill we will pay you this amount'

    No need to goto small claims court.

    A big thank you to Martin and this website. its important that we all keep this community going, i couldn't have claimed this back without the guidance and feedback of other peoples experiences.
