  • i am in the process of taking my bank to court and have done much studying before doing so to ensure i am doing the right thing.
    I am a little confused about the £10 per account. not sure why you need to pay that but i can tell you the following;
    i am sure that it doesnt matter whether or not you are under going debt management or not the fact is that the bank has taken funds from you and this is not lawfull. let me explain.
    you have 'bounced' cheques and dirrect debits and according to the law the bank is alowed to reclaim what its cost them to bounce the cheque or dd and send you a letter but not allowed to make a profit doing this. it doesnt take a genius to work out that it doesnt cost a computer to send a letter and a man to push a button £20-£30.
    (just for the technical part of this, 'the contractual provision that permits the bank to levy such charges is unenforcable by virtue of the Unfair Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law.)
    What all that meens is that although the bank has already taken the money they were not permited to by law, meening that in a court they would most likely be asked to give it back with interest.

    so the first thing to do is write a letter to the bank asking for it back. there are various free sites that can help with the wording. one i use is the consumer action group web site.
    They may well as in my case send you a letter after 3 weeks saying that any company has costs and this is theirs to fob you off.

    in my case i then wrote again explaining that if they do not repay the funds then i would apply to the county court to hear my case. This time no reply at all.

    So it was off to the court. The amount i have applied for to be returned is over £5'000. This cost me £120 but the cost is added to the banks debt to me.

    Paid up after 3rd letter,found moneyhad been paid into in bank account. fourth letter was on its way when they paid up in full.

    Hi I am in serious need of some help! I am new on this whole subject but my partner belives i have a right to reclaim.
    I have a normal current account with HSBC with a debit card and it was made clear to me that when i have no money left i cant get any out but i have no overdraft. i had a bad month a couple of years ago and ended up going over by £200. When i got paid money was taken to cover the debt. TO my surprise later on that month I recived a letter from HSBC telling me they were charging me £200 because of going over. so for going £200 in debt i was charged twice that to cover it. The problem is it hasnt stopped there i am now always in debt because of this. Please can someone give me some advise on this because i am at the end of my tether and cant think about anything apart from this debt.

    No you can't claim interest on your overdraft.
  • As per my previous messages.. I am trying to decifer the charges I can reclaim.. some are clear cut on the Natwest statements and called "referral charges" the other ones are just called charges... it doesn't give any more details... each month it says the date in the previous month that the charge was applied and then then the account no:

    "Eg: 30 JAN Charges 02 JAN A/C XXXXXXXXX 9.00"

    Does anyone think that these are potentially reclaimable ones?

    Give the bank a ring and check with them exactly what they mean by their terms.

    Not sure if anyone has the answer to this, but Abbey have charge me so far in excess of £200 for going 78p over drawn i have refused to pay money into the account and expressed this to both the branch and customer services team!! As i said this is a prime example of unfair bank charges, can i still claim money back even tho i havent (as such) laid out any money to clear these charges??

    Thanks, but also cn you claim charges back from the likes of capital one credit card and barclaycard? and do they shut you account down after they have paid out?
  • What letter do I need to send these people if nationwide refuse to refund the charges?

    Also can I claim interest now if I didn't state it before?

    Amount claimed: £950.50
    Amount paid: £810

    Decided to go for it as they were charging me £72 a month at one point. Got to the 'I am unhappy with all these bank charges, they total £950.50' letter. Really quick response from HSBC and now I can officially become debt free in 2007. Yippeeeee
