    Hi I would just like to say a big thanks. I didnt think I would get anything back from them. I requested Bank statements and they didnt even charge me the 10.00 charge. I requested 535.00 from Lloyds. After sending the second letter threatening them with court they paid up in full.

    I am now going through the same process with my other bank, Abbey. Lets hope it is as straight forward as Lloyds.

    I have now encouraged friends and family to do the same and have passed on the website address.

  • Help Needed.......

    I have just received 6 years of statements from natwest and have just started the process of calculating all charges.

    Can someone please let me know if I can claim unauthorised overdraft interest and do I have to put all charges down on paper when I send my 1st letter claiming money back.

  • I have arrangement fees on a business account with Lloyds TSB, which amount to £525 over a period of 14 months on an account with a £2000 facility. I do not feel that these costs are legal, the latest £100 was as a result of a 5 minute telephone 'review'.

    Should these arrangement fees be incorporated in my claim regarding excess borrowing fees assessed at £268?

    Hello all, I'm new to this forum but find all of your ideas and advice priceless!

    My question is basically if I am able to claim charges back. The circumstances are a little complicated but I will try and be brief.

    Basically, I had a bank account with HSBC and they messed me around no end which caused charges here and there in addition to the couple that were my own doing. I stupidly took a loan out for a 'mate' which went a bit pear shaped and was left a year later paying back a debt recovery firm. I no longer have a bank account with HSBC but it does fall into the 6yr gap allowed for reclaiming charges.
    Will the outstanding debt (which I have paid off religiously and am almost done) give them reason to not reimburse the bank charges? Probably sounds like a dumb question but I would rather know now. Also, do I follow the same procedure to get a list of the charges from them as you would if it were your current account?
    HELP, because I would love to get something back from the sods as they took loads of money for their errors not mine?

  • :confused: My mum is currently waiting to hear from the bank after submitting a claim through the courts as advised as she was only offered £490.00 for the £1000.00 of charges she was due.

    However as this is happening she has retired for medical reasons in work and has been charged hundreds of pounds of charges again whilst she's not being paid. What does she do about reclaiming these charges. Does she have to start the process all over again. This really just show how greedy these banks are. They have thousands of claims against them yet they just won't stop.

    Today was the last day before I started court proceedings, so they hung on till last minute.

    I would like to say thank you to everyone who gave me advice along the way and to anyone thinking about reclaiming their bank charges, definitly go for it!!

    Amount Claimed : Charges 1796.00, plus interest, plus legal costs £120.00

    Amount Paid : £1976.00 & £233.48 :T

    Details :

    24/11/06 1st letter sent to Halifax with breakdown of charges. They replied advising charges are part of t&c.

    11/12/06 2nd letter sent to Halifax giving seven days for full response before court action. They replied advising the matter would be passed to their Customer Relations Dept. As I considered their letter not to be a full response as requested in my letter I began court action.

    28/12/06 entered claim online; dated documents served to Halifax 3/1/07.

    Halifax acknowledged claim and had until 31/1/07 to reply/defend.

    17/1/07 checked bank account and two credits appear today; one for full charges and another for interest plus costs, just over £2000.00 No letter received yet.

    it can be done; don't be scared of the court process. the banks have gotten away with overcharging for too long.

    the entire process has taken 55 days; just under 6 weeks. :cool:

    this is the letter i sent to the bank, i sent this on the 3rd of jan.

    I refer to default charges applied to my account amounting to [INSERT TOTAL OF CHARGES], which I have requested you pay back.

    I cannot accept your offer of £985 as full and final settlement of my claim. I would only accept this as a part payment and without prejudice, but I will continue my claim for the balance.

    I wrote to you on [INSERT DATE], making the original request for a payment in settlement of my claim. As I have not received a satisfactory response, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the county court will rule in my favour.

    I look forward for a full response to this letter within 7 days, otherwise I will commence court proceedings to reclaim my money.


    i have not had a reply from them within 7 days, i thought i'd wait just a cpl more days and still no reply, what should i do now?
  • I am about to start trying to reclaim illegal charges on overdrafts by my bank HSBC. My worry is, as I also have my mortgage with them, can they force me to move my mortgage or is this breaking banking codes of practice.
