    You can use either, Martin has his letter, CAG have theirs.

    Use the Moneyclaim website in England and Wales (there's also the Northern Ireland Courts online) which can be used for starting most county court money claims, just go there and fill in the form. There’s a fee of between £30 and £120, depending on the size of your claim, which can be paid by a credit or debit card; though it’s refunded if, and hopefully when, you win. If you don’t have plastic to pay on, get the paperwork to start the claim from your local county court and pay there; it’s the same price. This may be waived if you’re on benefits.

    1. Has anyone actually got into court? What happened, can't find anything on success thread ..

    So far there are no reports on MSE of anyone actually going to court but thats not to say that this won't happen.

    2. My bank's defence is that the charges are not 'penalty' charges, they are for providing a 'service' (I'm not talking about standard 'service' charges that you agree too!!!) Does anyone know anything about this?

    That will be your bank's standard defence probably.

    3. Students Loans Company - my friend has loads of charges, can she claim for these?

    No idea.

    Amount received: £1000
    Sent first letter, replied within 4 days with £10 cheque returned, and with all 6yrs worth of statements. Sent 2nd letter requesting specific amount and included dates and amounts. They replied within 3 days with an offer of £1000. It's not the total amount due, but finances being tough at the moment, it was a great boost to help with the bills, so I accepted. They put the money in the bank account within 3 days. All in all I would highly reccomend anyone to have a go at at refund. It helps to get some pennies off them, instead of paying them all the time!

    Sent HSBC template letter asking for my charges to be refunded on the 23 dec, i recieved a letter saying they were reviewing my comments! i had a letter yesterday saying as a good will gesture they will refund "2837, great!!!! I can spend a bit more time at home with my 5 month old instead of rushing back to work. Iam now trying to get my others charges back from Abbey, see how i go!thanks Martin

    I'm sure this has possibly been covered before but, I'm with the HSBC and am expecting my past 6 years worth of bank statements back any day now. I am fully prepared to take them all the way if necessary to reclaim the thousands they've hadd off me in charges. My relationship with them has been bad at best and I'm worried that if i were to get any charges back off them they would shut my account. I am in a situation where I am unable to open another bank account due to my credit rating being so bad and the fact I am currently near the limit of my £1500 overdraft. I have an old savings account with the nationwide (a flex account?) that I haven't used for years is it likely I could change this to a current account?

    Also does anyone know how the HSBC have reacted to claims in the past? they are generally less than helpful be it on the phone or in the branch when I have dealt with them so I can't see them being too helpful if I'm trying to get money back.

  • Hi..can u help..I have been trying to reclaim £2150 from lloyds t,s,b..
    After sending the second template letter i received a letter saying they were paying £750 into my account as a goodwill gesture and no other corepondance would be entered into...Should i take the next step and take them to court...Or risk losing everything....HELP......
  • Banks can and have closed accounts so you do need to prepare for that, give Nationwide a ring and ask them if they will change your existing account.
