    I had to issue legal proceedings to receive some/all of my cashback
    Only Cashbacks 1 and 2 are due at the moment. So i presume thats all i can claim on?

    After issuing Mobile Rainbow with court proceedings they have finally paid me and my partner the money that was owed. I received £165.00 and my partner received £305.00.
    I would advise anyone who doesn't get their money by the due date to issue court proceedings against them.

    Has anyone kept a copy of the Terms and Conditions for Mobile Rianbow from Dec last year - i stupidly did'nt and am unable to access them on line (have been advised by them that they are being updated!).

    My moan - sent 6 mths bills in June today recieved my cashback of £39.38 - not what i expetected - advised that this is how it is worked out
    My bill is £35, mobile rainbow pay in four months installments based on your first nine months of bills (even though by your first cashback claim you have only paid six mths of contract)

    sooo £35 x 9 = £315 DIVIDE BY 4 = £78.75 DIVIDE BY 2 = £39.38

    if my bills had been recived on time my total cashback claim would have been £39.38 X 4 = £158

    my bill for the 12 months = £410 - I was under the impression half price cashback deal meant just that i.e £205 - BUT NO - i have had all the same excuses as you all - upgrading computers, 7-12 days etc etc.

    My second cashback installment bills were submitted due to me being annual leave and third cashback was given an extra three days due to the postal strike but only informed today i will recive no further payments due to 2nd claim being late - i am incredibly frustrated.

    The webiste is very misleading - i would urge everyone to get in touch with Consumer Direct - i contacted Herts Trading Standards who advised me to inform Consumer Direct - the more compliants lodged then surely this company can be looked at? and hopefully be closed down. I have informed TMobile and in the procss of contacting the other service providers - i know there is nothing they can do apart from cease buisness.

    Any further advice would be appreciated - along with acopy of T & Cs from Dec 06?

    Well then everyone. After sending a letter of intended court proceeding to MSols over a week ago they have still not honoured the claim (although i had an email off them to say it would appear. That should be handy in court!). Therefore i have filed a claim against them for the FULL amount of £300. They had their chance as my letter and email were very specific, i.e. Pay up by 31/10/2007 or a claim will be made against you. Hopefully the claim will go through okay.

    However some questions to everyone that has filed a claim.

    Did you have to provide reams of information regarding the claim or did they just pay up?

    Did you have to go to court?

    How long did the whole process take after you filed the claim?

    Did you use any templates when explaining what happened? If so where did you get them from?

    Don't worry about issuing court proceedings against Msols, it is so simple !!
    Go to Money Claim Online here.. https://www.moneyclaim.gov.uk/csmco2/index.jsp
    You will need to register your details.
    Follow the on line instructions. The page where you state why you are claiming goes directly to Msols, as well as the court, so state your case clearly, explaining that they have missed their own deadline for paying you. Also state that they are in breach of their own Terms and Conditions by not paying you in the allocated time.That is all it took for both my claims. No further paper work was needed. It will cost you £25 to issue the proceedings, so make sure you add it to the claim of £300.00 +£25, so the total amount claimed will be £325.00.
    I issued my claims on 2nd October and they paid the money in to my account on 25th October, without going to court. They e mailed and phoned me asking me to drop the case as they have paid me.

    You are also entitled to claim for interest on the late payments.

    The MCOL site shows you how to calculate this, and gives you the wording to use to add this into your claim.

    i didn't bother with the interest thing because the interest was so small that i didn't see the point. I used the bank charges reclaiming spreadsheet template to work out. It was less than £10 so i didn't bother.

    If you don't claim for interest on the original claim form, then you lose the right to it.

    Even if the case takes a long time to resolve.

    (Although you calculate the amount of interest due at the time of the claim, this figure gets increased to account for interest due between the original calculation and the date of the settlement).

    It's also extra pressure on the Defendant to pay out, (every day they don't pay costs them), and you could use it as a negotiating item should the Defendant want to negotiate a settlement prior to a hearing (it might be worth agreeing to waive the interest in return for the Defendant paying everything else and removing the need for attending a hearing).
