    I had to issue legal proceedings to receive some/all of my cashback
    I have now issued court proceedings on two accounts against this company for withholding the cash back money.They have 14 days to respond. I urge everyone to do the same to get what is rightfully theirs. I will update you when I have more information

I urge everyone to do the same to get what is rightfully theirs. It's so easy to issue them with court proceedings and costs only £25.00, which you will get back through the court. I will update you when I have more information

    i have just come to the end of my 12 month contract and have received one of three payments despite sending bills special delivery and on time.
    i didn't receive my first payment until i phoned and phoned and phoned.
    same thing for second payment,at least five phone calls, they tell you it will go direct into your account within 3-5 days,you wait, nothing.
    you phone backlog sorry,3-5 working days..they don't work sat/sun so could be longer.
    told yesterday,technical problem transfering money to account, it will be done today.
    i have told representator(there name)that i will hold my breath until it arrives and hold him responsible when i die.
    .never had these problems with e2save,carphone warehouse.
    i am now with 3 direct,couple of pound more but no hassle.
  • I've received all cashbacks due with some (non-legal) pressure applied
    I have just received my last cash back - what a relief! It was becoming increasingly difficult - Mobile Rainbow tell so many lies and give promises that payments will be made - it is only when I threatened legal action each time that they paid up. I did not ever have a problem with then saying they had not received my bills etc. but then I did not move house or change my home number. I now need a new cash back deal and have to say that I might need to go to them again......

    Can all the people that have claimed against MSols give me the details on what they claimed on?

    e.g. inconvienience compesation, time wasted, calls to them, etc.

    I'm currently waiting on 2 cashbacks and I am about to send my 3rd cashback details off.

    What would you suggest that i claim against? i.e. wait a bit and claim cashback 1,2 and 3 (3 will be posted off in 2 weeks)

    I wanna make sure that i bleed them as dry as poss as they have been giving me the runaround for months now.

    Can anyone advise?

    Go to Money Claim Online,at https://www.moneyclaim.gov.uk and issue proceedings against them . They are in breach of their own Terms and Conditions by not paying you in the specified time.,i.e. within 45 days of you making your claim. You should claim for all 3 cash back amounts, plus interest from 45 days after you made your first claim. There is a button on the claim site that allows you to do this. You need to work out how much interest you have lost to date, plus 8% for each day up until judgement is made.
    I have issued 2 judgements against them and I am waiting for their response to the court.

    Would it be possible to just put a £50 inconvienience charge (i.e. time wasted phone calls, stress, etc.) on or would that not stand legally?

    It won't make your claim invalid, though it might give them something to defend (they might argue the inconvenience claim unjustified/excessive etc).

    It depends on how you view the outcome of issuing the summons - if they don't make a defence, then you won't have to pay for a hearing.

    Conversley, if you expect a hearing anyway, then the claim won't be dismissed should they manage to get the "inconvenience" part struck out,

    Thanks for that. I think i'll stick with the original claim they have 2 weeks to pay the second claim. If they haven't by then i will issue a claim against them for cashback 1 and 2. Unfortunatly the cashback process is 4 equal sums of £75 to add up to £300 (i.e. 12 months at £25pcm). Also considering that i'm only 3/4 through my contract. It looks like i'm going to have the same trouble with them in 6 months time regarding claiming back the 3rd and 4th cashback. How on earth is this company still afloat with all this going on. It's the most amatuerish setup I have EVER seen!

    If you have kept to the contract conditions and not been paid, then you can claim for all the cashback due now in one claim.

    State that their action is a fundamental breach of the contract.
