  • Why didn't you just sue them months ago? THEN they'd have paid. It has always been clear that with this merchant there's only one game they play.

    Don't settle for just 2 cashbacks. You need to fight for what is rightfully yours. This is a common trick they play, that they haven't received it, then say the cheques in the post and can take 5-7 working days (ummm, post takes about 2-3days), then they say that there was a problem with the cheque department so they need you to confirm bank details (why didn't THEY call you, rather than you having to prompt them?).... they basically play for time, and expect customers like yourself to give up, so they save on having to pay out the money!

    I'm submitting my claim next month for £140, and if they don't pay within 45days, on the 46th day, I'll send them a nice email courtesy of the Small Claims Court for £140 + £30 court fee's + £50 for inconvenience (oh, and I might even just claim £140 x 2 for the remainder 2 cashbacks for the rest of the year, just because they have breached their contract). If they try to make me withdraw the claim, I'll be more than happy to play their own game... "i've contacted the concerned department (small claims court) to withdraw the claim and it can take 7-10 working days" :j

    I'm new on here, so I need all the help I can get! Mobile Rainbow paid my first cash back on time. They then claimed they had not received the second, so I sent them proof of the Special Delivery receipt. They are delaying all the time saying it is being dealt with and I would receive the money within 7 days, then another 7 days and now its within the next 15 days. I asked them to confirm that they had received my third cash back paperwork, and I was told that there was a problem , as I hadn't sent in all the phone bills. I know for certain that I did, as I double checked everything.
    It would appear that I need to start court proceedings against them Can anyone give me any help by telling me how to start this procedure? Should I write a letter to Mobile Rainbow informing them of my intentions?
    All advice greatly appreciated.

    Go on to hmcourts-service.gov.uk and you can issue court claim online. Its easy to do I have just issued 2 court claims to them and am waiting to hear.
  • Through no fault of my own I've lost some/all of my cashback
    I submitted my original bills by recorded delivery a couple of days after receiving my sixth. I posted on 31 July, but Royal Mail didn’t deliver to them till 8 August and was therefore one day over their 15 days from date on the bill (not the date you receive the bill). They have refused to pay me, even though I can prove to them I was not at fault and posted in plenty of time. Their website also says that as I have not been paid for this cash-back, they will not pay any future ones. So because of the Royal Mail I am now £420 out of pocket. I looked at their online complaints thing and it looks like I might get 12 first class stamps as compo.

    I have sent Mobile Rainbow a "Notice of Intended Court Proceedings", giving then 7 days to pay the 2nd Cash back amount of £140.00. I also told them that I would be claiming the 3rd cash back amount of £140.00 through the Court as they have refused payment because they claimed the paper work wasn't all there. I told them I knew it was correct and that I have kept a copy,and I informed them they would have to produce the paper work I sent to them in court as evidence. Can you tell me what form I need to use to take them to court please?

    My partner has just phoned Mobile Rainbow, and guess what?? They claimed that her third cash back paper work was incomplete, therefore they won't pay it.This is exactly what I was told 5 days ago about my own cash back claim. ( see#44) My partners and my own claims were sent on the same day, and both have not been paid for the second cash back and both were allegedly incomplete for the 3rd cash back.
    Mobile rainbow are nothing but con merchants who need taking to Court to stop this theft.
    We are sending another " Notice of intended Court Proceedings", this time on my partners behalf.
    I will keep you informed of proceedings

    I have now proceeded to judgement and told them so. They said they will pay my £140 and £30 court fees - I said because of all the hassle etc I want the £50 compensation too or I will still proceed. Got told they would get back to me - still waiting!

    I will carry on with this until I get what I want and feel is justified, you shouldnt have to chase for the cashback and I have had to chase every time. Told them this and also told them how many times I was lied to and hung on etc, said that I could prove how late they are in paying by printing my bank satement off and showing that to the court. Also said I had logged every call etc and will produce this in court, then got the feeling they may be backing down and paying me, as I said will continue until I get my full money and if they do not pay they will have 2 ccj's to their company name.

    This company is a nightmare - I have done lots of cashbacks before and never had this problem.

    UPDATE ON CASH BACK

    I issued a Notice of Intended Court Proceedings to Mobile Rainbow, giving them 7 days to pay my 2nd Cash back amount of £140.00. On the 7th day they deposited the money in to my bank account.
    I telephoned them twice and asked them if they were going to pay my 3rd cash back amount, because if not I was starting court proceedings to recover the £140.00, but as soon as I gave my details I was informed that they couldn't raise my details on their computer and I was informed they would ring me back within an hour, which they failed to do.
    I have now issued them with another Notice of Intended Court Proceedings for the 3rd Cash back amount, for which they alleged the paper work was incomplete.
    I will keep you updated on proceedings.
