It is all explained on the MCOL site, but I think you will will find that they will pay ALL of the money owed,as a goodwill gesture, not just part of it, when they realise you are willing to go to court.
Remember this company is stalling all the time so that they don't have to pay out. Believe me, I was given every excuse under the sun from this company as a delaying tactic, until I decided I had waited long enough. As soon as I issued proceedings they paid up.0 -
I had to issue legal proceedings to receive some/all of my cashbackI phoned MobileRainbow today for an update on my claim, which I sent Recorded Delivery on 25 October. The lady said that they haven't received anything for me, and asked me to confirm when I sent the claim, to which I said 3weeks ago... she put me on hold and said that they are currently experiencing a backlog loading claims on the system, and are going through all claims dated 19 Oct, so I should call after 5-6days when they come to 25 October claims... pathetic and lame excuse playing for time!!!
All I want is for confirmation that they've received it and it is being processed. In the letter, I've given them an ultimatum to issue me with a cheque within 45days as per the cashback T&C's, and given them 5 extra days for "in the post" excuses, so on day 51, they can expect to receive a letter from HMRC Claims for the full cashback £480 + expenses incurred, as I am not prepared to continuously chase.
Something tells me that I won't be receiving the cashback in time, and will be forced into submitting the claim via the Online Claims Court(!) Lol!
Don't wait for them to inform you if they have received it or not. Go to Royal Mails web site and check to see if the recorded delivery has been signed for http://www.royalmail.com/portal/rm/track;jsessionid=1QKFZFWGERYJ0FB2IGDENZQUHRAYUQ2K?catId=22700601&gear=authentication
I speak from experience with this company. I was given loads of excuses, like, the computer system is down, its being upgraded, we have not received it, we HAVE received it but it was incomplete, you will be paid in 15 days, 5 to 7 days, another 15 days etc etc.Give them 45 days from when they signed for the letter then issue court proceedings. I did, and got a total of £480 including court costs for my partner and my own cash backs. Believe me, you will never get your money unless you take them to court.0 -

I got my 1st cashback from Mobile Rainbow without too much hassle (a couple of phone calls) but the 2nd one has gone beyond a joke - it's been 3 months. I put up with their rubbish about 'backlogs', 'technical updations' and computer problems for too long so it's claim time. Thanks to everyone for the guidance on here. I'm a bit confused about the interest part though - probably a daft question but is the daily rate of interest that from my bank account? or 8% divided by 365?
Thanks & hope all the others putting their claims in get their money back ok.

You do the 8% divided by 365.
You initially claim for the number of days since the money was due up to the date of the claim.
Then when you win the case you ask for the extra interest that has accrued since the claim was originally issued.
(Or if they agree to settle out of court, you can ask them to add on to the claim the interest that has accrued since the claim was issued).0 -

hi i have managed to get my first cashback form them after threatning legal action however my second has now bwwn due for a while
will send them a letter to tell them about court proceedings, however i cant get through on their freephone number, it kept me on the line for over half an hour each time and nobody answered.
has anybody else had these problems if not which number have you gotten through on?

This is my first Mobile Rainbow contract and I've not yet reached the first cashback point"all" as in all the money outstanding on the contract.
ie. the lot.
hi Quentin i have 2 phones with mobile rainbow and my wife has 1 we are way overdue for our first cashback claim on all 3 we have had the usual we will pay in 7 days yarn my question is can i issue one court action for all 3 phones or do they have to be seperate many thx0 -
Each contract will require it's own MCOL.0
