  • This is my first Mobile Rainbow contract and I've not yet reached the first cashback point
    Does anyone know for my online court claim do i claim against mobile rainbow or MSols Limited

    You need to send a "letter before action" to them (hard copy in the post), asking them to pay up within 7 days of the date of the letter otherwise you will pursue the matter.

    You could address it to MSOLS Ltd, t/a Mobile Rainbow.

    Damn ive just filed my claim online does this invalidate my claim because i didnt sen a hard copy through i also addressed it only to mobile rainbow have i mucked it up

    You can cancel this claim, get your money back and start again.

    You need to ring the court today to do this as once the claim has been issued (which it will be tomorrow) you cannot get a refund. Ring the MCOL helpline.

    Then start again - send the LBA, then if it is ignored, make a claim against MSOLS Ltd, t/a Mobile Rainbow.

    Maybe you could read up the guide for claimants before starting again:

    Dear Sirs,Im writing to you about a fundamental breach in contract that you have made, my first cash back claim was due on 15/10/2007 (45 days after you received my first claim as stated in the terms and conditions on your website) total owed at present is £157.50 I have kept my side of the contract by supplying you with the relevant copies of bills and posting it special delivery then obtaining proof of delivery after countless hours of trying to get satisfaction out of your customer relations staff im afraid it has come to this final demand letter as you will appreciate my payment is now a fully 37 days late.I will be sending this letter recorded delivery and a copy will be made in case of further action. For your records my mobile number for which the contract is in dispute is xxxxxxxxx

    I look forward to receiving payment of this amount in full within seven days, failing which I give you notice of my intention to commence legal proceedings in the County Court without further notice.

    If it is necessary to pursue this course of action, please note I will also pursue interest and incidental costs.

    Is the total outstanding £157.50, or is this just the late payment?

    You are claiming they have committed a fundamental breach of your contract, so should be asking them for the total outstanding on the contract, not just any money late being paid.

    this is just the the money owed from first cashback claim the second one isnt due for another 20 days should i word it differantly then

    Yes - if you want to subsequently sue them for the whole amount, then ask them to pay the full amount in your LBA.

    But if you only intend to pursue them for the first cashback claim, then only ask for the £157.50.

    Though you are entitled to sue for the full amount now they have committed a fundamental breach of your contract.

    I intend to pursue them for all moneys owed but as of now im still in my phone contract so i have not received all the bills yet to pursue the 3rd and 4th claim(2nd awaiting confirmation)so what is the best option sue for each late payment or wait untill end of contract and sue for all 4 or are you saying i can sue for all 4 now even tho contract isnt yet finished
