I had to issue legal proceedings to receive some/all of my cashbackHi got a notice back from the court with rainbow offering to pay the first two cash backs via two installments, but they would not pay the full amount, now if I take this offer could I make it a condition that the full amount would be payable if they miss any of the payment dates.

I had to take them to court for the first payment. I claimed for the full amount which they didnt pay, but they did pay the first and second payments (as the second had now become due).
They paid the third payment on time with a bit of prompting from me reminding them that I had previously taken action and would do so again.
Time for fourth and final payment, same prompting no response so I filed a claim for the final payment this week. I have had an email saying my claim was verified and I would be paid in 10 days etc... so I gave them (the further 10 days) but said I would claim if the money was not paid at that point.
I just wish it was not this much hassle.
If the notice has come from the court, I would be inclined to hold out and see what happens.
The payment I got from MR came after they entered a defense saying that only the first two payments were due.

Hold out and take them to court? I take it they pay up on the court order you had?
If I knew I get some of the money I'd be a little more happy even if I have to do another court order for the remaining payments. Thats why I was hoping that I could make it a condition that if they do not make one payment of time the full amount would become payable.0 -
I had to issue legal proceedings to receive some/all of my cashbackA customer of collapsed Midlands cashback retailer Mobile Connections (Dialamobile) has had three of his Orange contracts torn up in a case that could spell trouble for operators.
The Communication and Internet Services Adjudication Scheme (CISAS), which settles disputes for Orange and T-Mobile customers, ruled the customer could end his contracts because of ‘significant changes’ from his original agreement.
Mobile operators have always maintained that cashback is a separate arrangement between the customer and retailer, but this latest ruling acknowledges customers reliance on cashback payments to pay airtime bills.
Roger Godsiff MP, whose constituents bore the brunt of the collapse, said: ‘CISAS has not just looked at the strict legality, they’ve looked at the moral obligations of the case, and I would urge other T-Mobile and Orange Mobile Connections customers to contact them.’
The Birmingham man, who had three £40 Orange contracts, was left without any cashback when Mobile Connections went bust in September last year owing £12m to 90,000 customers.
The customer claimed that without receiving any cashback he could not afford to pay the £1,496 demanded by Orange.
And he said it was not made clear that he couldn’t cancel prior to a minimum term without a penalty.
Head of trading standards at Birmingham City Council Chris Neville said it was the first case of its kind that he knew of, and he described the outcome as ‘a victory for common sense’.
Mohammed Afazal, who runs a support website for Mobile Connections customers said there were another 50 cases pending with CISAS, and they were ‘pretty much identical’ to it.

I have just purchased a sim free phone from these guys but think I've made a massive mistake after all I've been reading across the net. Basicly what are my rights if they decide not to send the phone out. The money has gone from my account so is there anyway of getting it back or cancelling my order?

You should be able to cancel your order. Read up on their cancellation procedure. If the phone hasn't arrived yet, then you will be able to cancel under the distance selling regulations.0

The problem is I was never sent an order number and they seem to require one when requesting a refund. When I try ringing the customer service number it just rings out. Any ideas anyone?0

I had to issue legal proceedings to receive some/all of my cashbackI have got a confirmation of judgement : Money has to be paid into my account by the 29th of March - only 3 days left and no money so far. They definitely have my bank a/c details as they confirmed it when I called them about 6 months ago. They have not contacted me in anyway since I started court proceedings so I have no idea what method they intend to pay (cheque/bacs). We'll have to wait and see!
For successful claimants - did MR ask you how you would like to be paid, or did they just send you a cheque or bank transfer?0 -
I've received all cashbacks due with some (non-legal) pressure appliedMR have sent an email today to both me & MCOL advising payment has been made, but no sight of money by cheque or in my bank account! They have also only made payment of 1 out of the 2 judgements that were due for payment by TODAY!
I have requested by which method of ayment this was made. (Was it an IOU?)

This is my first Mobile Rainbow contract and I've not yet reached the first cashback pointi sent of all my bills on time and they have confirmed that they have received them - but i have received no cash back. my contract is going to finish next month (end of april) and i have not yet received a single cash back. the phione number on their website is useless as no one answers and i keep emailing them and they reply saying that my cash back is top priority and will be delt with asap. ive been emailing them for months and they just reply saying 'we are dealing with your cashback' . they keep sending me the same email again which is ridiculous.0

I've received all cashbacks due with some (non-legal) pressure appliedSimpson123 the only way for force MR to pay is to use Money Claim Online (MCOL) https://www.moneyclaim.gov.uk/csmco2/index.jsp
First send a letter to MR advising that due to fundamental breach of contract you will be taking legal action unless payment made within 7 days.
As soon as 7 days expire use MCOL.0
