    Thats what i am wondering too, as everyone says you can do it but i have yet to hear from anyone who has suceeded when they have defended it. Im at the same stage as you awaiting an allocation questionnaire

  • I had to issue legal proceedings to receive some/all of my cashback
    This may come as very little surprise to anybody. MOBILERAINBOW will be entering administration in the very near future. If you are thinking of using MCOL you should do it sooner rather than later.

    Hi, on what information do you base this claim.
  • Through no fault of my own I've lost some/all of my cashback
    Just had 1st Cashback Claim rejected. They claim I have sent the 7th months bill although I have sent 6 bills. The 6th bill has of course got 1 month advance line rental. T&C state 6th Bill. Rejection states 6th & 7th Months bills. They are using the addition of the word months as the excuse although they are not in the T&Cs.

    If I have to take them through small claims ...... so be it!

    From start to finish a MCOL takes a minimum of around one month. Much longer if a defence is lodged. After that there is the time needed to enforce the judgement and clear any cheque.

    If your information is correct spending money on MCOLs now seems pointless.

    hi everyone

    i am another victim of mobile rainbow. i have taken two contracts out from them in november 2006. they gave me my 1st installment cheque after a long wait. i still havent heard from them for my second and third cashbacks. i have sent them recorded delivery letters threatening them to court. I also have been in contact with trading standards about it. i have been trying to call them since monday but the number doesnt go through.

    Is it too late to make a claim through MCOL? as they owe me £520 all together...

    Please advise

    In reply to Paul Bailey and Nicole 136, the advice that i received from Consumer Direct when Msols had refused my 1st cashback was to claim for the whole amount there and then. They were adament that i was to do this as Msols had already breached the contract. They said that if Msols were not complient at this stage then it is unlikely that they will be in the future. And i had nothing to lose as Msols state that if 1 cash back is refused then so will all others. I however am not aware how this has stood in a actual hearing.

    Also i have now received their defence and no where does it mention that i failed to make further claims, so i assume that if the contract was already broken by them then it is no longer binding. However i am not an expert on these sorts of issues so hopefully someone else may know for certain!
