    I had to issue legal proceedings to receive some/all of my cashback
    I issued my LBA today!

    I had to issue legal proceedings to receive some/all of my cashback
    Mobile Rainbow owe me ~£1000 for 2 contracts (12 months free), all my cashback claims have been on time via special delivery. I filed my MCOL on 29th Jan 08, and after they extended their defence time as they said were going to defend their claim (up to 28 days) they have admitted they owe it in full! I have just sent off my judgement form giving them two weeks to pay. Hopefully I'll get this before they go into administration! I also claimed £11 interest at 8%! Good luck everyone else! File the claim ASAP and don't wait around ....I've been waiting for them to go bust since about december in honesty!

    You can ask for immediate payment - there is no need to give a defendant who has kept you waiting months and months any further (legal) time to pay you (or go bust!)

    I do not dispute what you are saying, but what you wrote is heresay, what evidence do you have?

    I would like to know this as any evidence presented may influence what direction i may take in my proceedings against MSOLS, if there is any evidence of course.

    Lots of networks do not allow certain dealers to sell thier phones, this alone is not proof that they are "going in to administration"

    Good luck, keep us posted with updates as to if and when you get the monies you are owed and if you encounter any further issues.

    UPDATE
    Finally got my Court date for Mobile Rainbow. Letter from court asking if i would consider mediation and to call them this week, if i choose not too then will be heard by the judge. Sorry, given several chances and warnings prior to claim, so no mediation and straight onto court - can't wait.

  • Hi got a notice back from the court with rainbow offering to pay the first two cash backs via two installments, but they would not pay the full amount, now if I take this offer could I make it a condition that the full amount would be payable if they miss any of the payment dates.
