    Simpson123 the only way for force MR to pay is to use Money Claim Online (MCOL)

    Winning a MCOL doesn't force the losing defendant to pay up.

    You have to pay up front the fees involved in taking legal proceedings. These are non refundable by the court, but will be added to the defendant's debt to you if you win the case.

    If a losing defendant can't pay, then the courts can do nothing to help you get paid.

    Before issuing a MCOL make sure that the defendant will be able to pay you should you win the case.

    I had to issue legal proceedings to receive some/all of my cashback
    29th of March has gone, the deadline they were given to pay my claim by the court - assuming they don't pay on Monday, what do I do now?

    It is up to you to enforce the judgement.

    If you are happy the defendant can pay, then apply to the court for a warrant of execution (cost of this is added to your claim).

    When granted, the warrant will be passed to the bailiff to collect the money for you.

  • I had to issue legal proceedings to receive some/all of my cashback
    I filed a claim for £420 cashback through the courts in January and the company offered me £235 including court fee now and the rest when due. I accepted the offer figuring if the company is about to go bust I must as well secure half the money and sue later for the rest. The company requested a month to pay which I accepted and it suprisingly paid on time! I will be suing for the rest in June.

    i filed a MCOL claim asking for...
    £202.50 (1st 6 months of cashback)
    £25 (court fee)
    £30 (personal admin)

    they admitted to owing me £143... stating i made the wrong calculations... the cheek!?

    i sent the form back to the court and also a copy to MR with cover letter stating i was not happy, telling them they were still in the wrong.

    we'll see what happens i guess!?
  • Just to let people know I submitted a claim in Jan for the full cashback owed of £315 - going up to £350 with costs. Msols didn't submit a defence, judgement was granted and I requested immediate payment. Last week I submitted a warrant of execution to get the money and they have now paid £350 into my account. I will be chasing the £55 for the warrant fee oncethe £350 has cleared.

    hi,
    i statred proceedings against MR on 17/01-got reply on6/02 from MCOL that MR admitted part payment-i agreed tfor amount but asked for immediete payment as they were asking to pay by 20/03- on 19/03 got a letter of judgement mentioning MR are suppose to pay money within one month or challenge within 16 days from the date on envelope (it was17/03)-on 29/03 i got another letter from MCOLsuggest

    sorry above mail was from my side don't know what happened in panic. anyways here is the rest of the story......
    so i got letter from MCOL on 29/03 mentioning: We are unable to register two limited companies. Please advice whether registeration relates to: a) Limited company trading as a firm. b) Joint judgement against two limited companies. c) Other- please specify
    please send the form required for completion N244 with £40 apybale to HMCS.
    now the thing is Mcol has got defendant's address as :
    Mobile Rainbow Msols Ltd,
    Msols Ltd.
    The parade, xxxx
    xxxxx, xxxxxx,
    watford,
    wd1xxxxx.
    my problem is i that, i can't understand what should i give as answer. i mean am i claiming from Mobile Rainbow or Msols Ltd....??? i think that's what MCOL is confused about as well. any help is much appreciated. thanks
