    I had to issue legal proceedings to receive some/all of my cashback
    Some progress with my claim: MR have admitted owing the amount claimed, but guess what? they want until 4th June to pay. I'll be following what others on here have done and requesting to the court that is not satisfactory and they pay immediately.

    They have acknowledged my claim and said they intend to defend part of it. I will wait and see what they do but I imagine the bit they intend to defend is the compensation I claimed for.

    I imagine they will offer to pay the cashback owed (minus the expenses I claimed for such as special delivery and stamped envelopes) but presumably at a later date (ie June).

    If they do say this they can foxtrot oscar, and I will be telling the court as much (though perhaps in a more considered manner :rolleyes: )

    Hi, I am in a similar situation: MR owe me just more than £200. I sent them to the court and they promissed to pay me via a few installments. But no payment received so far. I emailed them several times (bothe complaints@ and cashback@) but no response. Which way have you used to contact them? Thanks pt01

    Did you get as far as a judgement? If so, and they are in breach of the court's instructions on paying you, then it is up to you to enforce the judgement.

    You can apply to the court for a warrant of execution, and when the warrrant is issued the bailiff can try and get your money.

    But if you accepted an out of court offer to pay you in instalments, then you will need to pursue your claim - either by continuing the original claim, or if not possible starting again from scratch.

    Both avenues will involve you in more up front court fees, so be sure they will be able to pay you before possibly wasting money on them.

    filed a claim in small claims court scotland cost £44, mr are not defending it but want till 20 june to pay out the £ 230 they are owe me, if i want to challenge this iv to appear at court to say so, but the sherriff can still say thats a resonable time scale for them, then im out off pocket in wages for time lost being at court, dont know what to do now,

    Update:

    I had 2 accounts with them, being owed 2x£581.

    One week after issuing enforcement and paying another 2x£60 for bailiffs charge (which was 2 weeks after the due date for payment) I have today received 2 emails from MSols:

    Dear Sir/Mam,

    We are in receipt of the Judgment for Claimant from the Northampton County Court.

    It is to inform you that we have made the full payment of £581.22 via Wire Transfer on 14th April 2008, as mentioned in the Judgment for Claimant.

    We have also marked a copy of this email to the claimant.

    We request the Hon'ble Court to ask the Claimant to cancel the Judgment.

    This sum of £581.22 was before the enforcement charge, so I'm still out of £60! I'm pretty happy as I was always under the impression that I wasn't getting a penny back...spending £120 is better than losing £1160! I'm not going to cancel judgement until they pay the bailiff charge though ;-) . The money has only been deposited today so it's not showing up on online banking, but it does show theyre still currently just about managing to pay cashback claims! So keep persevering! ....but I'm not sure if you haven't started to start a new claim :S How much longer will they be about?!

    First off, no-one can "cancel" the judgements.

    All that can be done is the judgement marked paid - but not until they pay you the full amount on your warrants of execution.

    Once the money has cleared into your account, inform the bailiff of the part payments and the bailiff will proceed to get the remaining amounts. outstanding.

    I phoned the court people yesterday to ask about warrants, having objected to Mobile Rainbow's offer to pay me by June 8th. They said that they advise people to wait 14 days after rejecting an offer before proceeding with a warrant in case Mobile Rainbow pay up. Given mine and everyone else's previous experience, I think that the chances of that happening are pretty remote. Quentin - do you think it would be worthwhile pushing ahead with the warrant now?

    Hi All

    I'm currently in the process of claiming for 2 consecutive cashbacks. Originally msols acknowledged the claim saying that they were going to defend all the claim i put against them.

    I have now recieved a full admission off them saying that while they dispute the claim put against them they in fact do owe me all the money (the amount i claimed off them) however they have said that due to problems getting rebates off the 3 mobile network (yeah right!) and they would not be able to pay me until the 30th june. For fear of them going into admission would their request be deemed as reasonable by the court? Bearing in mind that they were supposed to pay me over 3 months ago. Where would i stand legally is i rejected the terms set by them and asked for it asap on the basis that they are already overdue by 3 months on paying it and that they have been paying other claiments straight away?

    What does everyone think of this situation?

    If you want paying immediately, then request that from the court when you apply for judgement.

    The court will decide, and order them accordingly.
