    Awais09, all the answers are in this thread, you should begin by reading it from the start, there is great advise about how to send a 'Letter before Action', and then filing a claim through Moneyclaim.

    That's how I managed to get my money back.

    If you want to claim statutory interest for late payment you calculate the amount due from the day the money should have been paid up to the date the claim is submitted.

    The daily rate referred to is an amount (£x.xx) that is due each day the debt remains unpaid.

    Then if you win the case, when asking for judgement you also ask for the extra interest that has accrued (on a daily basis) between the date of issue of the summons up to the date of judgement.

    I had to issue legal proceedings to receive some/all of my cashback
    Im currently in the process of getting my cashback via legal action through moneyclaim, iv just been on mobile rainbow's website and they're now just a price comparison website. Will this have an impact on their paying cashback?

    I read most of the posts here and since I am in a similar situation with lots of people, I went a head and put a claim which cost me £25.00. Now I had a look at my account on MCOL and I have been asked to Issue a Warrant which is costing another £55.00.
    I was wondering if I have to pay this to be able to get my money back? If I pay this, will it be refounded with the initial money?

    If so, when were they ordered to pay you the money by?

    This is what it says in the judgment section of my account,
    "our judgment request has been accepted. The order has been sent to the Defendant."

    You will get a copy of the judgement through the post.

    This will show by when the defendant was ordered to pay you.

    If they don't pay you by that date, then you can (if you want) apply for a warrant of execution (fee £55).

    This gets passed to the bailiff who will attempt to get all the money they owe you (including this £55).
  • Through no fault of my own I've lost some/all of my cashback
    I have been trying, with absolutely no joy, to get a dispatch note. I didn't receive one with my phone - the package had to be collected from the PO - it was damaged but I did not suspect anything was missing as I had everything I needed to get up and running. It was only on reding the details about how to start claiming that I realised something must have been missing. I am the most organised person you willl ever meet and have kept everything that I have received from mobilerainbow, including copies of all emails, the original order etc. I am getting nowhere. I was warned by other people who had had bad experiences with mobilerainbow but took a chance. I had a cashback deal with e2save last year - absolutely no problems whatsover.

    Update on my situ,
    They have offerred a part admission, saying only 2 out of the 4 claims are over due. The joke is that in there statement they say

    "we accept that the claimant is entitled to the amount of £208.76, However it is respectfully submitted that we need time to make the payment for the amount submitted"

    Like they have not had enough time? They must be mad to think anyone would accept that empty promises of payment again.

    3 cashbacks are overdue and im sending the 4th in monday so it will all be overdue by the time i go to court anyway. besides im suing for their breach of T+C's which should allow me to get the lot upfront.

    I only hope it does not end up costing me anymore
