    Check out www.moneysupermarket.co.uk, someone has had a bounced recorded delivery from Phoneboxdirect, same p.o box as CNM.

    In what ways is it not legally binding?? Is there like a law or something I can quote when they tell me this. End of the day I signed a contract and agreed to the orginal terms what right do they have to change it when and where they see fit without informing me and giving me options?

    I quote 'The Unfair Terms In Consumer Contracts Regulations 1999’ which says that 'a consumer is not bound by a standard term in a contract with a seller or supplier if that term is unfair.' and that 'a standard term is unfair if it creates a significant imbalance in the parties’ rights under the contract, to the detriment of the consumer, contrary to the requirement of good faith'

    A particular standard term in question is 'We reserve the right to amend these terms at anytime.' which is clearly unfair.

    There is a recent court ruling mentioned earlier in this thread which I believe supports this and I have mentioned 'recent judgements' in my correspondence with CNM.

    As a matter of interest I notice the latest t&c's appears to allow photocopies and has extended the period for claims to 60 days!! Possibly as a result of the judgement referred to above?

    "anytime", if it's a word at all, is an adjective - "any time" is what they should say - grr! The same stupidity often occurs with "everyday". Either way it's an unfair contact term.
    Time is an illusion - lunch time doubly so.

    Hi, Its great to know that now they have a 60 day time period for cashback claims.
    Could someone please help me calculate my claim month?

    My date of connection is 20 March 2007. My bill date is 17 of every month. If I calculate 120 dates from 20 March 2007, 18 July 2007 is the date after 120 days. As I recieved my bill on 17 July 2007, should I send only Aug 2007 bill?
    The customer care people are not telling us the exact date. Now that they have a 60 days time period, if someone could please advise on this,
    I will still have a chance to send my July bill.

    With regard to timings I can only give you mine which have worked;
    1. Connection 3/5/06, sent bill dated 4/9/06
    2. Connection 21/12/06, sent bill dated 21/4/07
    3. Connection 2/3/07, sent bill dated 4/7/07

    Unfortunately for you all mine have the bill either exactly 4 months or a day or two longer whereas your timing comes out a bit under which seems odd.

    Certainly on T-Mobile you get your first bill issued either the day you are connected or the next day but I'm not sure how that applies to you.

    The t&c's indicate the key issue is to send the bill 'showing you have been connected for 4 months' (i.e have paid for 4 months) and I think you need to check which bill shows that.

    I took my 2nd contract out with them in May this year & yesterday, sent an email requesting that they confirm whether or not I need to send the dispatch note, this is the response I received today;

    "Thank you for your email.

    Along as the claim form you have has the address :

    Mobile Affiliates Limited
    Claims Dept
    PO Box 8895
    Bingham Nottingham
    NG13 8XA

    and does not ask your to send the despatch note it is perfectly fine for you to claim without one.

    However if the claim form you are using states you do need to send the despatch note then it is compulsory that you do.

    Avoid CoolNewMobile at all cost. Didn't check the reviews here before I ordered a mouthwatering deal, paid the price.

    No communication what so ever after placing the order and when chased up their fulfilment wing (Dextra Solutions) says somebody "attempted to contact me" for additional information. I cancelled the order straight away only to find the next day that my credit card has been charged £2.50. Nice. Excellent terms and conditions to pocket few quids with and online ordering system with few 2 bit HTML pages, no matter whether they fulfil or not.

    My advice is - toss a coin before signing up to any business operated/affiliated to or by Claudwell group.
