    Have u had any word yet, you and i started our contracts around the same time, Ive had confirmation of receipt of my final claim, and it has been passed onto the next stage....which i believe is the stage that confirms whether youve sent the correct paperwork.

    Although all my previous claims have gone ok(60+days, but didnt care about that), I am a little concerned about this one as my final bill was only for £3 or so, when i was expecting it to be £33......and am sure my provider has missed a bill out, but i rang them and they said all was correct...I'm waiting for CNM to confirm or reject.

    There is no point in writing to them, just phone up the bank and raise an objection againt that transaction with the following points
    - transaction was made without your consent
    - you think the Merchant is acting fradulent without giving right information

    Thats enough for them to investigate. You will be credited back your money after their intial investigation (2-3 weeks)

    hpuse: could you put your message under the quoted material please? It's the logical way to read and the way it's done on bulletin boards, despite what Microsoft would have you think. :D

    Hi bassman. Yes, I received confirmation on 5th, a mere 13 days since the claim was signed for. :rolleyes: As I've said before, this is just the first stage of their strategy of delay - keeping the emails just far apart enough that you don't start hassling them for progress reports. (Didn't work with me - I queried the delay the day before the email arrived, resulting in a further email later.) There is absolutely no justification for this delay, of course.

    My claim is also complicated somewhat by the first page of the bill showing a different tariff (the one that started on the anniversary) but the other page I sent shows the old tariff up to the anniversary. My enclosed note (all photographed before sending) explains this.

    Well...still going through my learning phase...not yet there ;) ..oh yeah, and I'm pretty bad at my spellyings, hence I use MICROSHAFT to correct them and then the great copy-paste technology:rolleyes:

    You've just done it again! If you use Firefox (although maybe only on Linux!) then you get a spellcheck in the reply box, so no need to cut and paste.

    Thats right. But even when they write-off without investigation, they record the company details. Such information is collated and archived for future references.

  • i have spoken to trading standards and am seeing citizens advise today. I even wrote to The Times (where i first read about this 'money saving deal'.I forgot to send CNM my second page invoice in my first claim. So now my whole claim is invalid. Can they hide behind this T&C? I hope some legal person can help all of us. It sounds as like if I had not forgotten my second page, there would have been another reason for them not to pay me. They can see that I am still on DD and subsequent invoices show my contract. Go to CPW for your new cash back. My husband has had no problems with them.

    IF you did omit a page which was asked for I'm afraid you have to blame yourself. If you didn't, sue. I am playing their game now and there's no way they will get away with anything with me. My first claim is going through; I was actually hoping they would try it on. They have other chances to do so though - and I'll be ready and waiting if they do. The dishonesty of the dealers is in fact often a double-edged sword; whilst trying to force their way out of their side of the contract through various means they do expose themselves to a downside which anyone can exploit. Forget consumer direct, trading standards etc. Go for the jugular and don't mess around with them - or walk away from your cashbacks and put it down to experience.

    With a 12 month free deal YOU are getting a LOT of benefit. Many people on here reckon you should never do these deals - "you don't get something for nothing", or "if it sounds too good to be true..." etc. If anyone takes up such a deal they should expect to get it right or suffer the consequences. I detest the dishonesty of ALL the dealers - including cpw now. However, I am prepared to play the game carefully and anyone who takes up such a deal must understand the rules and take supreme care (more so than ever nowadays as customers of the cpw sites will find out shortly).

    Two things in this case I would specifically suggest. 1) Check what was ON the missing page (AND that it WAS missing). If it didn't include the items listed in the t&c (tariff, name & address etc) I think you'd have a good argument in court. 2) Thanks to the games they are playing you can NOW submit the missing page (OR a copy) as long as it gets to them within SIXTY days of the statement date. Since they are now saying they have varied their t&c to allow themselves 45 working days (they haven't!) to pay, THAT works both ways. They cannot pick and choose WHICH terms and conditions apply retrospectively and which don't. In any case, sort out your strategy and don't mess around around if you decide to take action.

    Having said that I knew that I would have to be careful and comply with them, which I did. It is the dishonesty which makes me and many others very angry. In my case it was alleging I did not send the 2nd page of the bill showing the tariff, which was posted to CNM within 30 minutes of receiving it. I am now waiting to see whether they are going to defend my claim in court, they have until the 19th September to decide.
