  • Following a previous successful yearly contract with cool new mobile, I took out a new contract with this company in august 2007, the phone never arrived and after considerable dialogue with them and some procrastination on their part, i decided to go elsewhere, cancelling verbally and in writing.
They have failed to inform the phone network provider and i am now receiving bill for a phone I never received.
I would warn any potential customers to be very careful!!

  • They're awful, I am going to have to take them to court because even after sending all my cashback rebates off as requested, they have refused to honour it. I am now severely out of pocket on what was meant to be a free line rental.
I have copies of all my bills and the dates I sent them off, so I am going to take them to court. I told them this but they still just sent me a standard email "claim not recieved, end of story"

They did not try in any way to resolve my problem, AVOID!!!!
  • We do not need another Coolnewmobile thread. Will the Mods merge this please.

As you have to sign for a phone upon receipt, ask them for the proof of delivery.

Did you send items by Special Delivery? If so you can track their progress on the Royal Mail website. If you didn't then I think you will not receive your cashback.
  • Success !!

Phone call this afternoon from Mobile Affiliates.

Bottom line is they have agreed to pay my 1st cash back + £50 court fee. They will post the cheque with confirmation that my contract is reinstated either today or Monday. I would have liked the full five cash back amounts but it is a reasonable settlement so I couldn't refuse.

They obviously do not want to go to court so I would advise anyone who had my problem to hold their position and battle it out with them.

Well done. Did they also apologise for lying about you omitting to include a bill page in your claim, which is what they have in effect admitted to, or did they couch it in terms of "gestures of goodwill"?
Time is an illusion - lunch time doubly so.
  • For those who are concerned about the changing of their t&c, you may find this interesting. When people took out their contracts with t&c allowing 28 days to claim and were subsequently told they would only have 21 days under the new t&c anyone downloading claim forms THEN would discover the time HAD indeed changed on the new download to 21 days. I have just checked now that they have changed the t&c again a while ago to allow 60 days after substancial pressure from trading standards and consumer direct. I am certain any judge would be most impressed by the fact that downloading a claim form now STILL shows 21 days. He would think it very reasonable and fair that they wish to reduce the claim period for existing customers when they introduce new terms (which they'd be most unlikely to get away with in a court of law anyway, methinks) yet NEXT time they change them in the customers' favour they DON'T change the downloaded forms to 60 days - not EVEN back to 28! Now, it's lots of little things like that which would have them laughed out of court (or wrapped severely over the knuckles).
  • The lady I spoke to was obviously in a senior position in the company. She was very apologetic and even asked for my advice on how they could avoid problems such as mine. She agreed that nobody should have to have a witness or photograph a claim and bills prior to posting. She had read all the correspondence in my file and agreed that I was a careful person who would not have left a page out, especially as it was posted within 30 minutes of it being received. I told her it was not helpful to receive an email stating that a claim had been received and then getting a letter stating it was incomplete. If anything was wrong with the claim it should be stated in the first email.

She stated they were abiding by the new OFCOM conditions, 60 days to post the claim and allowing photo copies of bills. This applied to every customer.

Just MAYBE there will be less problems in the future.
