months ago started a mobile contract where after x months you send a
bill in and claim cashback....
Anyway, did this a few months ago, and send all the relevant docs as
per the terms and conditions of the offer. Today I have had a letter
telling me my claim has been disallowed because the handset despatch
note was missing from my claim. Funnily enough, this letter was
recieved 1 day after the 60 day limit on claims had passed, so I cant
sort it out, so they're not going to pay at all...
However, a few things to note:-
1. I did sent the despatch note with my claim - and I sent it all
recorded delivery. Bit convenient that one important doc has now gone
missing.
2. The original T+Cs (which I printed out when I took out the offer)
did not mention the despatch note in any case. It appears the T+Cs on
the website have since been changed.
I've pointed this out in writing to them, and am hoping they're going
to see sense.
All sounds like a bit of con here by this company. Surely they cant
carry on like this?
If they say no, what can I do about it? OK. I can take them to small
claims court but what are my chances? Amount is £84, so how much would
that cost to start a claim?
BTW. My wife also did the identical same offer, but started a few days
after me. Whats the betting that shes about to recieve a similar claim
denial letter ??? :-)0 -
A claim for £84 will cost £30 - and will be added to the claim, so that if (when) you win, they will pay that back to you along with the £84, (plus interest if you also add that on to the claim).
Though if it goes as far as you issuing a claim, then instead of just claiming the one instalment, claim for the total they agreed to pay you back originally, as the contract has been broken by their action - which is a fundamental breach of the contract.
Read up on other CNM threads and you'll see this is not unusal behaviour from them.0 -

I have been trawling for a deal and the best I can find with full 12-month refund by redemption is with coolnewmobile. This is a 12-month contract and they have this deal with O2 & 3.

Currently I am with 3 and obtained my PAC code today ready for the move. I have been sending my vouchers back to Dial-A-Phone this last year for 1/2 price line rental without any problems, so I would recommend them, but…….
1,who are "cnm"?
2,has anyone had dealings with them?
3,will they pay back the line rental?

I can't believe they can get away with changing the T&Cs after you've signed up for the deal, especially if they don't inform you. I'm sure the small claims court would take a very dim view.
I think in law the terms and conditions that existed at the time of the contract start would apply rather than any revised ones....0 -

Would be much easier to do the lot in one go - that would be £420 !!!!
Yeh - I've read the other threads. Not surprised at all. Quite a con they seem to have got going here.
Wonder how it'll end uop if they do contest and it ends up in the small claims court. At the end of the day, its their word against mine.0 -

Dont hold your breath. They;ll give you the impression that its all ok then at the last moment when you're expecting the cheque - make up some excuse to say your claim is invalid...0 -
Paulfoel,contact consumer direct/OFT for more advice. You need to send them a complaint and warning letter to sort the problem out or get ready for legal action. Please read previous pages for more information from people who have been in similar situation like yours. It seems there is no end to CNM scam of either missing bill page or despatch note.0

I sent my first claim off on 16th August 07, they received it 17/9/07 as i sent it special delivery. I've not had a email confirmation yet to say if everythin is OK or not.
I have emailed them to ask if everythin is OK and had the below reply back on 5/9/07Dear Mr xxx,
Thank you for your email. I can confirm that we have received your 1st claim on the 17.08.07, but as it is still in its early stages there is no status on the claim yet.

Yes their email service is slow.
You could try ringing 0870-0422172, option 3 and then asking them. You will need your CNM order number. I think after receiving, the Bingham centre processes the claims(1 or two weeks further wait) and then they pay in another 45 days.
At least they are prepapared to speak to you about cashback unlike some mobile companies although they are slower than Buymobilephones.net0 -
Have been waiting for my 4th bill to arrive in order to send off 1st claim under this contract, and I notice that on my Vodafone bill, it states 'As your price plan has changed, we've credited back any unused credit....etc..'
All I did was add on their 'passport' service, the one where you pay 75p & then use your inclusive minutes when phoning from abroad.
This is free, but you have to register for the service.
Is this now going to jeopardize my claim?0
