;6304430]Today I have had a letter
telling me my claim has been disallowed because the handset despatch
note was missing from my claim. Funnily enough, this letter was
recieved 1 day after the 60 day limit on claims had passed, so I cant
sort it out, so they're not going to pay at all...
2. The original T+Cs (which I printed out when I took out the offer)
did not mention the despatch note in any case. It appears the T+Cs on
the website have since been changed.
I took my contract out in May, and there was no mention of having to send the despatch note, however, after following this thread, I did e-mail them & received a reply as below
I have kept a copy of the e-mail just in case!
"Thank you for your email.
Along as the claim form you have has the address :
Mobile Affiliates Limited
Claims Dept
PO Box 8895
Bingham Nottingham
NG13 8XA
and does not ask your to send the despatch note it is perfectly fine for you to claim without one.
However if the claim form you are using states you do need to send the despatch note then it is compulsory that you do.

I have followed bobtheboys actions and issued my small claims action through the online facility today.
I was surprised at how easy the process is. I shall update if any outcome.0 -

Phone call this afternoon from Mobile Affiliates.
Bottom line is they have agreed to pay my 1st cash back + £50 court fee. They will post the cheque with confirmation that my contract is reinstated either today or Monday. I would have liked the full five cash back amounts but it is a reasonable settlement so I couldn't refuse.
They obviously do not want to go to court so I would advise anyone who had my problem to hold their position and battle it out with them.
Bob
Bob,
How did you approach them in the first instance with this? So you had to issue a court summons to get some action then? Did you issue a summons for the full amount of cashback or just one installment?
Was this the first installment? Why did they disallow it? They're trying to claim I missed out a document (I DIDNT!)0 -
Please read the thread. I have posted several times on my actions as I went along. Bottom line is I wrote to them stating I had sent all the bill and gave them 14 days to reply. They still insisted I had not so moneyclaim online it was.

She agreed that nobody should have to have a witness or photograph a claim and bills prior to posting. She had read all the correspondence in my file and agreed that I was a careful person who would not have left a page out, especially as it was posted within 30 minutes of it being received. I told her it was not helpful to receive an email stating that a claim had been received and then getting a letter stating it was incomplete. If anything was wrong with the claim it should be stated in the first email.
She stated they were abiding by the new OFCOM conditions, 60 days to post the claim and allowing photo copies of bills. This applied to every customer.
Just MAYBE there will be less problems in the future.
Bob
But now all they do is wait and sit on the claim for 61 days and then tell you you've missed a form (even if you havent). This is what they've just tried with me.0 -
Folks,
Same as Bob, got my cheque today for first claim and cashback claim reinstated in full. They settled 'out of court' Only 4 more claims to go!!
Don't hesitate to use the moneycliam system. It works. They do not want to go to court. This means that they cannot get away with their 'lost' and/or 'missing' tricks.
Bob,
I agree with your last post. Chisel away at them. No mercy though if the next cheque is late. I will be gining them written notice with my next claim that if I have not received my cashback cheque by post on the day following the due date that I will be online at the moneyclaim site again without further reference to them.
For those considering a summons for 'lost' claim keep your details in the summons simple. Give the reference number and the amount due for the first claim. Don't elaborate.
Good luck,
Neill
So I'm not the only one to have a claim turned down because they've lost some of the stuff I sent then?
Did you enter a summons for the whole cashback amount or just the installment due?0 -

If you want your money back please read this entire thread. It may take some time but you will be able to skip a lot. It will be worth it and you will see what CNM are playing at and how to beat them. It was my 1st claim so potentially I was going to lose £420. It was the "page missing of my bill" trick.

I've just started my claim and am surprised I can't attach any documents and there isn't much space for describing what has happened.
I can only really then say that I did send the whole bill and they say I didn't. Do you have any thoughts.
Trevor
Dear All
Just an update.
After serving the claim and extended discussions between my father and CNM, they have paid his second claim and the court fee and reinstated his contract.
I now get my neigbour to witness that the copies I have kept are what were put in the envelope and he signs across the seal of the envelope.
Regards and good luck
