    This is my first ever post on MSE but due to my frustrations i wanted to make others aware so they dont make the same mistake.

    Have an account with CNM and sent in my 1st and 2nd cash back claims in NOV 06 & JAN 07, all went well in receiving cheques except for the upto 60 day delay from the date of them confirming receipt.

    The PROBLEM began on the 3rd claim!

    Little to my knowledge my girlfriend had been sending in the claims via normal 1st class mail....

    Of course she sent her 3rd claim in on time 10th MAR 07 (20 days prior to expiry).

    We went abroad on holidays on the 13th MAR 07 and got back 1st APRIL.

    I checked my emails upon my return and noticed there was no email confirmation from CNM suggesting they had received the 3rd cash back claim!

    I rang them and spoke to a fairy abrupt woman in the claims department who suggested there was no 3rd claim for cash back in there office from us.

    Now am told that as it's after the 30 days of claim period I have lost all entitlement to 3rd..4th...and 5th cash back claims!

    TOTAL LOSS OF £252.00!!!

    PLEASE PLEASE PLEASE be aware that it is your word against there's when it comes to proof of posting.

    DO NOT send by normal 1st class post and PRESUME it's being processed as my girlfriend and I are now having a major argument between us because of her silly error!!!

    I am not holding my breath but i have just sent a formal two page letter to Mobile Afiliates explaining the error and hoping they may show some flexibility due to the so called MISSING/MISLAID post from Royal Mail!

    I am very much a sceptic and I personally believe they received the 3rd claim but as i have no proof i am up the creek without a paddle!!!

    I have suggested in my letter they show a little compassion considering word/mouth, repeat business and negative media exposure is not ideal for their future business etc.... so we shall see the outcome hopefully in the form of a reply from them!..

    Anyway im not asking for compassion or "i told you so" comments from anyone on here, just want to make everyone aware of how to cover your backsides! USE RECORDED DELIVERY ONLY!!!!

    Any outcome or advice or similar cases would be greatly appreciated though.

    I think it's fairly unlikely that a user who only posted once, in April, will be monitoring this thread! Rather than quoting the whole of an enormous posting to add one line of your own, a private message might have been more appropriate, and would probably have generated an email to the user. :smiley:

    Agreed. Its just trying to convince CNM of that (they are pretty thick!) and proving it...

    Same thing with me and my wife. Both got rejected cos they reckon one item was missing - yeh right !!!!

    I honestly believe those customers that get paid now are very lucky. I wonder what percentage of pages are allegedly not received. To disqualify the 1st claim is their best choice.

    Exactly what I think. I reckon they grab a percentage at random and decide not to pay them.

    Like you said, by disallowing the first claim they're saving a shedload of money...

    I'm hoping that if I put a bit of pressure on them they'll give in and move on to easier pickings (like people who wont complain about it and just accept it)

    This should just be a simple case of sueing them as they are in breach of the original contract. Trading Standards should be able to get the T&C's which applied at the time. I can supply you with a copy of the T&C's dated 21/01/07 if you need them. Or get TS to order CNM to comply with the original terms.

    I sent the despatch note (T+Cs no mention but on claim form) but they still reckon I didnt send it !
  • Just receive my cheque for cashback and court fees so I am happy - for now !

    Sent off my next claim, witnessed by a neighbour.

    I had been waiting for my 4th Cheque for over 2 months and they had ignored all emails and they just lied on the phone, so yesterday morning I thought, OK enough is enough. I already have one claim to start on Friday, I'll start one for these scammers.
    Anyway, I sent them an email around 1100 am and basically informed them that I'll be starting Court proceedings on Friday if I have not received my 4th Cheque on or before Friday Morning.
    Guess what turned up today, my 4th Cheque. Cheque printed and dated 24th August but envelope franked Yesterday, sent first class. No reply to my email of course.

    I cannot believe that people are still asking whether they should take out a contract with these scammer, flippin eck, there are warnings on here, MoneySupermarket and HUKD about these guys.
