Make no apologises for keeping this on the front page.
Anyone considering this company should read all the posts.

I have JUST fallen victim to the "missing page" scam. Conveniently for them - this happens RIGHT at the end of the 1st claim period.
It's SHOCKING and RIDICULOUS any company thinks they can get away with this. Speaking to the person at the end of the phone on their lines was pointless (even more so at their 0870 rates - GRRRRRR) - she informed me I had to write to their claims department.
"Let me SPEAK to them."
"No"
"LET ME SPEAK TO THEM"
"You can't."
"I am going to lose £470! If it was YOUR money what would you do?"
"I can only advise you of the procedures."
"What's their EMAIL address?"
"They don't have one!"
"You mean to tell me you SELL STATE OF THE ART MOBILE PHONES OVER THE INTERNET AND YOU DON'T HAVE EMAIL ADDRESSES? Let me SPEAK to them!"
"You can't!"
"!!!!!!? Give me your manager."
"I can only inform you to follow the complaints procedure in the terms and conditions."
"The complaints procedure tells me I can 'make a complaint by any reasonable means for example, letter, telephone or e-mail. Most problems can usually be settled within a reasonable time in a hassle free way.' I AM ON THE PHONE TO YOU NOW MAKING A COMPLAINT!"
"And I have tried to resolve this, send a LETTER to the department."
"Who's to say you don't CONVENIENTLY lose the letter of complaint I send you via recorded delivery? This is ALL so inconvenient - LET ME SPEAK TO SOMEONE" (at this point I am IRRITATED and SHOUTY)
"Look, I can see this is going nowhere and I'm putting the phone down." *click*
USELESS PEOPLE, USELESS COMPANY.
The ENTIRE BILL is present in the same envelope - there is NO way anything is missing UNLESS one of their staff members has lost it!
The onus of proof is with THEM to prove that parts are missing; I have made ALL reasonable efforts including emailing them a scanned copy of the missing page; they REFUSE to accept "online copies of pages." They have OBVIOUSLY received part of the claim - the REMAINING page is WITH THEM!
Seriously, they're expecting people to video the pages being inserted into the envelope, video the entire journey to the post-office, and video the process of sending it out via special delivery. I'm wondering just what will happen to the other FIVE claims we've made!
Called Trading Standards and informed them of everything; her words of wisdom are invaluable and I'll be following her advice to the tee - in 8 days time I'll inform you of the outcome.
Those of you making a small claims case - please get in touch with me too!0 -

You have a PM.
This is getting ******* ridiculous

To those that would like to get there money back quite simply and without the use of
1. Trading standards
2. Solicitors
3. Citizens Advice Bureau.
4. Watchdog
5. Consumer direct
6. Multiple and disallowed multiple witnesses.
Read the thread on The Mobile Outlet, especially the one by the Cashback collector(post #7). The post is with regards to T.M.O, but just substitute the information given and this can be used for any company.
While others are dilly-dallying and trying to get them shut-down, there is a chance that you will get your money back in the prevailing time.

I've started a new thread showing a list of those affected. Please keep discussion on this thread, not the new one.Time is an illusion - lunch time doubly so.0

Certainly do not to get them closed down, otherwise no money for me !
Will try every avenue without court BUT the bottom line is I want my money they owe me.
Bob0 -
Thanks for the heads up thesaint; VERY interesting post there by CashbackCollector.
I actually sent all correspondance by special delivery (upto £2500) - I did ask for postal insurance and she (the woman at the post office) said this was it. She never told me about consequential loss insurance, GRRR!
Additionally; CNM declined one of my Quidco earnings (and I had 5 contracts with them!)
All the rest went through ok. Because they give you something ridiculous like a week to respond to declined payments my right to respond through Quidco was nullified. *grr*
IF they are closed down I'll claim through the banks or through their other mobile companies; failing that I'll make life SO inconvenient for their Directors they'll just wish they didn't bother - yes; I am that anal. I'm certainly not willing to lose out a conglomerate £2800 on mobile tarrifs!
I've just contacted T-Mobile and informed them of the situation with one of THEIR resellers - I don't believe THEY can get away with providing mobiles through shoddy resellers. Don't know when they'll get back in touch with me on the matter but it's on their systems.
CNM are pretty much in bed with Dextra who are HUGE - so I don't think they'll go down anytime soon! Don't know anything about Mobile Affiliats other than the fact that they run a LOAD of shoddy cashback companies. Dextra, MA and CNM all seem a way too convenient beaurocratic slurry.
So - today I send off a stern letter holding CNM in breach of their terms and conditions and see where it goes. HOPEFULLY all of us claimants live in opposite ends of the UK - I'd love to see them travelling around in the hopes of defending ALL claims against them.
You know what infuriates me the most is that you just KNOW it's a scam. Of course I knew of the harsh TnC's when I signed up - I MADE DAMNED WELL SURE I dotted all the i's AND j's! I scanned everything in so I had copies; I sent everything via special delivery and I SECURED every envelope effectively (this thing was dog proof!;) I called them SEVERAL times over confirming dates, the arrangements, etc - I had EVERY future cashback claim organised in nice neat envelopes - ALL the relevant paperwork signed and organised - it was a true SAS operation here.
Fine - I know you have inconvenient terms and conditions - sod it - I'm covered because frankly, I'm organised!
You do ALL of that and the guys decide to screw you around through fraud. Now there's a contingency that I didn't plan for. Perhaps in future we need to HAND the relevant paperwork in ourselves in person.0 -
@gromituk: 24/06 was the date of my first claim. They've only JUST gotten back to me about that though.0
-
Thanks - I should make it clearer - I'm posting the approx. dates they are refusing cashback as that helps to establish their pattern of behaviour better I think.Time is an illusion - lunch time doubly so.0

I've just had a call from Trading Standards re: my claim.
I don't really want to give out all the details at the moment until I get full clarification, but the gist of it is Nottingham TS and the OFT are dealing with this and have contacted CNM regarding my case. I have been told that they are WRONG in changing the original T&C's as far as they have, although the CAN make minor changes. TS and OFT are working with the company (CNM) with a view to re-instating my original T&C's and are monitoring my case regarding cashback payments. Unfortunately they can only deal with each individual case, and I have been told that each individual should contact initially their OWN Trading Standards/Consumer Direct and NOT Nottingham direct.
I can say that Nottingham TS and the OFT are fully aware of the antics of CNM and have had lots of complaints and the company IS being investigated.
One area of the contract being investigated is the one where "one missed claim forfeits all cashback payments", this looks unfair, surprisingly  . So this may benefit all others with different mobile phone companies - hopefully they will have to change this particular term.
Ironically today I have received an email from CNM giving the standard OK message regarding my claim and I will be contacted within 10 working days to inform me of my expected cheque date.
I voiced my concerns regarding missing bills etc. and was told to continue to claim as normal and any future problems I may have with CNM just to contact TS again, and they will deal with it.
I have had a terrific service from my local TS, top class in fact, more than what I could have expected and advise anyone with problems with CNM or indeed with any of the other problem mobile phone companies to contact their own TS's
REMEMBER THE RIGHT PEOPLE ARE AWARE OF WHAT CNM ARE DOING, AND ARE TRYING TO STOP IT. HELP YOURSELF AND TS/OFT BY REPORTING THIS SCAM.
Lynsey
Just to add, it's Mobile Affiliates Ltd who are being investigated as a whole and not just the CNM side of things.**** Sealed Pot Challenge - Member #96 ****
