    Thank you yabbas, I will now go next week to CAB office, could not go today and will book an appointment closer to the time when the 14 days notice period ends to CNM to plan legal action against CNB with CAB help.

    I am just about to send off my first claim to CNM but I noticed that on my bill an extra 20 pence has been charged for sending text abroad. The T+C state that you have to remain within the tariff. Does this mean that I have blown my cashback by sending 1 text @ 0.20?

    No, you haven't. To remain within the tariff simply means staying with the original price plan that you signed up for the full 12 months - not upgrading or downgrading. Sending an SMS abroad is just like going over your inclusive minutes when the calls become chargeable or making a call to an 0845/0870 number which is not covered by the allowance.

    If it comes to Court action I would rather have names and addresses than names and comments on an internet forum. It would be all down to credibility and real names and addresses would carry a lot more weight than anonymous identities. I have had 3 members PM me who are willing to act as witnesses so any more would be very welcome. Of course I would do the same.

    My father has just received the following email from [EMAIL="claims@mobile-affiliates.co.uk"]claims@mobile-affiliates.co.uk[/EMAIL] in response to his email notifying them of his intent to institute legal proceedings within 14 days if his cashback was not paid.

    Thank you for your email. We are confirming, via this email, that we haven't received your tariff page for your second claim and this now voids all future claims, in line with our Terms and Conditions and also our claims form. This decision is made as we have not received the correct completed form and bill within the prescribed time given. When you purchased the mobile phone package you agree to submit the required claims in to us within the prescribed time.

    Your only option now is to supply further information to confirm that this claim has been sent to us correctly to enable our Customer Relations to investigate your claim. This has to be done by writing to;
    Customer Relations,
    Mobile Media Systems Ltd,
    Opus House,
    Preistly Court, (This is copied from their email but checking the Internet it should be spelt Priestly!!)
    Staffordshire Technology Park,
    Stafford,
    ST18 0LQ.

    including the relevant information.

    He has also contacted Consumer Direct for their advice. He doesn't seem to have a copy of the conditions relevant at the time he placed his order and the ones I have are May 06 and Feb 07.

    Trevor, as your fathers original contract didn't ask for a bill showing the tariff page, he doesn't need to include it. Has he reminded them of this??????
    This should just be a simple case of sueing them as they are in breach of the original contract. Trading Standards should be able to get the T&C's which applied at the time. I can supply you with a copy of the T&C's dated 21/01/07 if you need them. Or get TS to order CNM to comply with the original terms.

    Unfortunately he doesn't have his original contract so I'm not sure whether it is as mine dated May 06 or yours dated Jan 07. As such he is not currently pushing this angle but I'll keep it in mind.

    Does anyone out there have a copy of their t&c's dated 21 Dec? (or shortly thereafter)

    Actually a copy of the claim form from 21 Dec would do as the wording on this has changed from 'tariff charges' to 'tariff' as the t&c's.

    Its funny that the claim form reference '15232241zxssdd12ooc' didn't change!

    In a way this is irrelevant as all pages were sent anyway.
