I've been thinking about that Bob, it would give a good insight. The T&C's can't be changed, although CNM think different. I should find out at the end of this week whether they will re-instate mine or face prosecution. When confirmed or other I will reply.

I honestly believe we have enough potential witnesses to make a criminal complaint. I will wait until my claim is finalised and see if there is any support. I would certainly be prepared to make a statement to the police (I am a retired police officer !)
Mobile Affiliates are acting criminally and should be prosecuted.

Hi trevorh, the information from my terms document is as follows:
"Cash backs are claimed in five equal instalments
Instalment 1: - Send us the claim form and original bill that arrives showing you’ve been connected for 4 months. i.e. if you were connected on the 1st of January, you need to send in the bill that is dated around the 1st of May. This is 120 days (4months) after connection. See porting below
Instalment 2: - Send the claim form and original monthly bill dated 180 days (6 months) after connection.
Instalment 3: - Send the claim form and original monthly bill dated 240 days (8 months) after connection.
Instalment 4: - Send the claim form and original monthly bill dated 300 days (10 months) after connection.
Instalment 5: - Send the claim form and original monthly bill dated 360 days (12 months) after connection.
Porting (keeping your old number)
when making the first instalment claim at 120 days, with a PORTed number, we need in addition to the standard requirements above, a copy of the first bill showing the original number we supplied to you.
Claiming
The claims address is on the cash back claim form we sent to you by email when you ordered your handset. Please return only one claim per envelope.
We will email you when your redemption paperwork is processed on to our system.
Sorry but we are not able to return originals. So please take a copy for your records. "
The royal mail is on strike from 25th july for about two weeks if I am not wrong. I will update you about my letter as well.

It's been said elsewhere that you should claim for everything, but I'm not so sure - after all, in order to obtain everything under normal circumstances you have to send in all your forms. I'm not sure a court would award you more than you would otherwise have got by ruling that the whole claim should be paid out without you having to go through the normal procedure to claim it. I'd only claim for the refused amount and continue to send subsequent forms in in the mean time.
In other cases with other companies(eg TMO) the lot has been claimed for and awardedCouponing....."every little hurts"

Today I received an email stating cheque would be sent out in the next 10 working days. They received my first claim posted by Special Delivery on 8/6/07.
Yesterday I sent off my second claim which they received only this morning and believe it or not it was acknowledged as being received at 4pm today. I got a bit neurotic and photo'd all pages sent in different ways, numberered the pages, copied the bills and sent a letter reminding them Trading Standards were monitoring my claim. Letter as below, hope I covered everything - definately getting neurotic !!!!!!!!!!!!!!!!!!!!
Will see what happens this time.

Start date: 23/01/07
Bill sent: 24/07/07 (covers bill period up to 23/07/07) which is as requested showing 180 days/6months after connection.

As you will be aware I am in dispute with yourselves regarding the original terms and conditions being changed. Trading Standards have been in contact with both your company and myself informing both that the original terms and condition must apply.
My contract is being vetted until it’s conclusion by Trading Standards and any discrepancies will be passed on to them to deal with if necessary.
Enclosed is a fully completed cashback form and all three sheets of my appropriate bill. All sent documents have been witnessed and verified as well as being copied for use by Trading Standards and yourself if necessary.

...oddly enough the recorded letter I sent out to their 'complaints department' on the 24th of July STILL hasn't been "Tracked and Traced".
Fearing the worst (i.e. an unmanned complaints dept) I called Royal Mail and they informed me that First Class delivery could take upto 15 days to be delivered.
FIFTEEN DAYS FOR FIRST CLASS DELIVERY!?!? Jeez. I should've sent it Special! >_< Damn them.0 -

My father contacted Consumer Direct (who I got the impression were the online public face of Trading Standards) about his 'missing page' rejection.
Amongst other things the issue of changing t&c's was raised and their response was 'The trader may be able to make amendments to the terms and conditions of the contract. However, if the changes are significant you may have the right to cancel your contract.' which doesn't seem as helpful as the answer you appear to have got.
The issue of other complainants was also raised and they responded that 'we do not hold any information on companies that we are able to give to consumers' so couldn't advise if similar complaints had been rec'd.
I guess we'll just continue through the small claims process.
