    We need to get together on this.

    Will anyone who is currently in dispute with CNM PM me so we can collectively have backup when we go to the Small Claims Court. Only pm if you are prepared to go that far.

    I have a horrible feeling they will go bust before then.

    I've looked back in this thread to the beginning of April, and these are the people who have been affected by CoolNewMobile admitting receipt of claim but saying that the relevant page of the bill was not enclosed:

    Zulfib + 1 06/07
    chicarg 06/07
    Asiya 07/07 (second claim)
    fareastangel 21/07 (first claim)
    bobstheboy 21/07 (first claim)
    yoursminelunch 21/07 (last - fifth - claim)
    yabbas 24/07 (first claim)

    That's 8 people and counting (I will update this posting as time goes on).

    As you can see, this is a very recent phenomenon. They are getting desperate (the courts will take a dim view of this tactic), and I agree with bobstheboy and others: I think they are on the brink of bankruptcy.

    Publicising the problems will help prevent others taking out contracts and being fleeced in the same way, but will, ironically, make things worse for those of us (including me) who already have a contract because it will reduce CNM's income and therefore make it more likely to go bust earlier. However, morally I think it's better to warn people before they get sucked in, and also I believe there is a delay because CNM won't get paid by the network until the end of the contract, so anyone not signing up now will only affect them in a year or 18 months' time. (If they can see their sign-ups tailing off, though, they're more likely to declare themselves bankrupt earlier.)

    I'm just sorry for anyone who's only just signed up - I have so far received 3 out of my 5 equal payments (plus Quidco payout and, of course, a handset and a year's use of it). Everyone should be aware that they should never take out a cashback deal if they can't afford to live with the consequences of this deal failing.

    You are lucky that you have had 3 payments, mine was my 1st.

    I was well aware of the dangers of a company going bust but I did not think they would act dishonestly. I will not be having bread and water if they do go bust but am angry that they are blatantly lying, I bet their shredding machine has been working overtime.

    I will not let this rest, that is against my nature.

  • sadly i agree with the general consensus that they are about to go belly-up. My cashbacks have been taking gradually taking longer and longer.

    we do need to stick together and also find someone who has experience of going to small claims court etc

    Although I sympathise and am in the same boat it's not necessarily positive to keep assuming that they are about to disappear. They have been around a reasonable time and as significantly just about ALL dealers have recently beeen taking MUCH longer to pay than usual. I strongly suspect it's because of a combination of competition and the networks taking longer to pay the dealers. In any case, I will see how I get on and have not ruled out future contracts depending on that. The Mobile Shop - which USED to be the best and safest - has apparently been struggling for about a year. The Mobile Outlet - notorious for as long as I have been following them - has ALWAYS acted like this. Phones2U appear only ever to pay up if they are taken to court. Remember, most people would never go that far and they know it all too well. That means the rest of us may well get paid one way or another. In business, talk and rumours purely on speculation that a company may "go bust" sometimes become a self-fullfilling prophecy and so I would strongly suggest people attend to getting their cashbacks rather than worrying or speculating about that!

    I can understand, but not condone, CNM saying they did not receive ordinary mail, but to "lose" a page of a bill sent Recorded Delivery is very cheap. What are we suppose to do, video the pages going into the envelope ? I know, ask the next door neighbour to witness the deed.

    I honestly believe those customers that get paid now are very lucky. I wonder what percentage of pages are allegedly not received. To disqualify the 1st claim is their best choice.

    Hi bob, how will fight against CNM collectively, can you please explain this? i have already complaint to trading standards and they are investigating the problem. May be everyone else who suffered similar problem should contact their local trading standards advisor. I also submitted a complaint at watchdog website, may be other people should consider doing it so they may investigate it if loads of people are complaining against same company with same problem

    It is good to complain to these bodies but they will not get your money back. If, after I have sent a letter recorded delivery, I do not get a satisfactory response, I will start Small Claims Court proceedings against CNM for all my cash back. If that is necessary, I would like a few more names and addresses of people who have an identical claim. This will strengthen my claim and they can do the same.

    I have sent a report via the Watchdog BBC site. If others do the same they may do something.

    Bob I can understand your frustration with this matter, but, have you researched your proposal to use names of other people in your court case?

    I have seen your type of 'Class action' lawsuit in America, but I have my doubts that your £30 fee to court will enable you to deal with anything other than your claim.

    If you can direct me to a case where this method has been sucessfully used I will stand corrected.

    I didn't propose to have a collective action. The other people scammed by CNM will be witnesses in individual cases. I am prepared to be a witness if others are.
