Just an idea. As CNM are Nottingham based, why not everyone with a grievance direct their complaints direct to Nottingham Trading Standards. I know my complaint has been passed there. Surely it is better to have a central point for all issues. Surely this is looking like a scam or a con. They might even offer advice on how to overcome the problem.

I will chase up what's happening to my problem (T&C's change) later on in the week.
Best of luck to all,
Lynsey
Just an update, today I have been advised by my local TS that it is best to contact your own TS/Consumer Direct and not Nottingham direct. Anything that needs to be passed on to Nottingham TS will via your own TS's and they will monitor your own individual case.**** Sealed Pot Challenge - Member #96 ****

Good idea. I will contact them tomorrow.

Wishing you luck Bob. They will probably already have a profile/case history on CNM, and it should all add weight.

I agree with Bob regarding the witness idea as it will lend support to each other's claim as we are all in the same boat. I agree with Lynsey's idea of contacting Nottingham's trading standards, i will ring them tomorrow as well. Also my other concern is if CNM are about to go bankrupt, then we can still loose our money as winning a case in the small claims court does not guarantee money back if a company goes bust or bankrupt!0

We just have to hope they do not go under. If we worry about losing another £30 by taking Small Claims Court action, CNM have won. Civil court cases are decided on the balance of probabilities rather that beyond reasonable doubt which is required in criminal law. If we stick together and agree to be witnesses, we can beat CNM and expose this scam.
Be positive and if court action is necessary go for it.

Update
I have just spoken to Consumer Direct 08454040506. They collate information and advise on action to take. They also pass the information on to the local Trading Standards office (Nottingham)
After giving them all the information their advice was exactly what I proposed. Give CNM the opportunity to agree to my
complaint and put it right. Keep copies of all correspondence and send by Recorded Delivery. If they do not respond satisfactorily within a reasonable time (14 days) commence Small Clams Court action. Any information regarding other people having the same problem is definitely an advantage.
Please PM me if you have the same problem and are willing to give me your name and address if necessary.0 -
Hi there,
I emailed CNM about my 2nd cashback which I had sent in May n got an acknowledgment on 11th June .
This is what they say
We can confirm your claim has now been assessed and everything is in
order. I have authorised this claim for payment and we will forward it to
our cheque processing centre. They will contact you in the next 10
working days and let you know when your cheque is expected to arrive with
you.
Kind Regards
Cool New Mobile
So hope that I will get my cashback. Fingers crossed
I wanted to thankyou a million times but its a shame that I can press the button just once :T0 -
Yeah, and look at the next delaying tactic: the two weeks or so it will take to get from the box on the desk marked "authorised" to the box on the desk marked "write cheque".
claim received -> receipt acknowledged -> claim assessment -> claim approved -> cheque written -> cheque sent. Each arrow is a foot-dragging opportunity.
"We will update you by email at every stage of the operation so you can be confident with the progress of your claim" = "we are doing everything in our power to delay sending out your cheque for as long as we possibly can, and in the mean time will fling you the odd auto-generated snippet of information to try to stop you hassling us"
CNM = cynicism of the highest order. Never again.Time is an illusion - lunch time doubly so.0 -
Hi,
I am another victim of the lost pages scam for the second claim. CoolNewMobile have claimed a page is missing from my bill though it was in the envelope and sent recorded delivery. I have reported them to Birmingham Trading Standards.
They have also ripped my wife off at the same time with the same scam on the same day. After all it is a nice earner for them. Each person on average will be ripped off £200 - £300 so if they scam 10 people a day that will be a nice £2K - £3k PROFIT.
What can we do other than to get a solicitor to validate our paperwork before we send it or better still the solicitor posts our claims? This is ridiculous. We our now just under £700 worse off. It is THEFT. There is no other way of describing it. These professional thiefs have scammed us and reading these posts many others also.0 -

Quite possible and if deliberate it could be classed as fraud. Might not sound so silly as to complain to the police - might sound "pie in the sky", but this is so regular now it appears "iffy" and needs to be investigated. Even consult a solicitor for the legal point of view, normally the first 30 minutes are free. Another possibility is to try and find out if there is a students "work experience" option, where the students would take on a case, if viable at no/little cost to yourself as course/work experience. There is one in the North East who do this kind of thing, there must be others.
