hi , i rung leicester court this morning regarding insolvencys, guess what, there is an 8 week waiting list to go insolvent. when you call they give you the next available date, and its 8 weeks time!! so any orderes they took in last 8 week must have fraud!0

I don't think the bank would accept this for their forms though? Also, PKF have said that they're not actually insolvent yet and the decision will be made next week. How does the process work? Would they have applied to the court before the letteer we were sent, or will that be the next step after next week's meeting?0 -

I'm no expert on insolvency, but from what I understand I think it is the creditors (especially the banks) who call in the receivers. If the receivers believe that the company is recoverable then they will often run the company until a buyer can be found, or finances can be sorted out, or the company is deemed to be insolvent by the courts.0 -
OK. They're not in liquidation, because they need the creditors meeting to establish that, because they're not able to declare themselves solvent:
Section 4 - Creditors’ Voluntary Liquidation
56.165 Introduction (amended March 2009)
Where the members are of the opinion that the company cannot by reason of its liabilities continue its business, and that it is advisable to wind up they can cause the company to resolve by special resolution that it should be wound up voluntarily.
Notes: [Insolvency Act 1986 section 84(1)b]
56.166 Calling the creditors meeting
Once the resolution for a winding up has been passed the company must within 14 days hold a meeting of its creditors.
The duty to call the meeting of creditors is the company’s so it could be called by the liquidator, if any, appointed by the members, a director, or the secretary. It is common practice for the meetings of members and creditors to be held on the same day but the 14-day period is to ensure that the directors have time to prepare the information required by section 99 (see paragraph 56.171) to be laid before the meeting. The creditors’ interests are protected during the 14-day period by the limited powers of a liquidator or the directors once the resolution has been passed (see paragraph 56. 168).0 -

56.167 The notice of the meeting
The notice of the meeting must be sent by post to every known creditor not less than seven days before the day on which the meeting is to be held. The notice must also be advertised in the London Gazette and in two newspapers local to the company’s business area.
The notice must contain either the address of an insolvency practitioner who will provide the creditors, free of charge, with information regarding the company’s affairs, or details of an address near the company’s principal place of business where a full list of creditors can be inspected, free of charge, two days prior to the creditors’ meeting.
Note my underlining. To me, this suggests that the IP should be prepared to provide us with information regarding the comany's affairs. I think I'll email this to PKF and ask them again to provide me with information regarding suppliers. I'm wondering about asking them for information on orders made by FD too. They must have the information and why shouldn't they give it to us?0 -
I know it looks like I'm talking to myself here, but- if some people have sent information to the PKF that suggests wrongful or fraudulent trading, then that should be investigated by them (based on HMI's information pages). If that happens, it would hopefully provide a stronger case for everyone.
So, if it were concluded that wrongful trading had taken place from a certain date, surely anyone making an order after that date would be able to claim via their bank, as the directors of the company would have been found to have been taking money from us all, with the knowledge that they couldn't supply the goods.
It's the job of the insolvency practitioner to get the best result for the creditors, so they should follow this up...0 -
Hi all,
Having found the money had been returned back into my account I was overjoyed but arriving home there was a letter from Lloyds bank......
"I want to update you on the progress we've made with your enquiry.
We've contacted the retailer's bank to try and resolve this dispute. In the meantime we have credited your account while we investigate......
It is possible that the retailer will refund you themselves, or provide proof that the transaction is valid.
If this happens we'll need to re-debit your account - we will of course advise you before we do this.
It goes on to tell me to inform them of any new developments.
I am still waiting to hear from Morris furniture as to when they told FD that they could not be sent any goods.
When I do I will post their reply.
The card I used was a Lloyds TSB Visa Debit Card so for people using a Visa Debit card there is some hope of a return of money.
My worry now is what lies will come from FD in support of this claim.0
