Protecting an elderly person's money when family access may have been misused
I’d really value hearing from anyone who’s been through something similar. I’m helping an elderly relative with dementia whose finances have become complicated. While she was abroad for a while, another family member had her bank card and access to one of her accounts. Looking back through statements, there now seem to be…

ISA APS confusion
Hello all, I'm at the stage where I have the probate, but I'm a bit confused about ISA APS. Do I need to write to the half dozen banks and building societies the deceased held cash ISAs with and ask them to release the funds to the probate account I have set up? Once I've distributed the money to the beneficiary (his…

Inheritance theft
A relative passed away 3 years ago and left the will to 4 beneficiaries including 2 siblings and 2 children. The executor was related to one of the siblings and was eventually stripped of his status as executor for not providing statement of accounts and for non-distribution of funds. When payment was made it was paid from…

Just looking for some guidance- myself and my mother jointly inherited my nans house. We have the grant of probate and the last step is now transferring the property. We have decided to do it ourselves as it seemed a straight forward process and the company who handled probate for us were messing us about. We have an…

Equiniti
Equiniti couldn't be worse if they tried! Having advised the death and sent the grant of probate we then instructed them to sell 3 different share holdings: Company A - worth about £500 Company B - worth about £1500 Company C - worth about £9000 We completed the sale form (single form for all three holdings) after finding…

I am an executor, if I die can I leave those duties to my sister
I am the sole executor for my Mother who died in 2020, to dispose of her estate and look after my brother who has continued to live in the family home since then - he is ESN and difficult to deal with. Under the terms of her WIll if he cannot look after the property then it must be sold and the proceeds divided between…

Should we have registered the trust?
Afternoon all, My mum died almost three years ago in Feb '23, and in her Will she left her half of the house (that she owned as Tenants in Common with my Dad) in trust with me and my sister as the beneficiaries, and also alongside dad as the trustees. It was my understanding back then that we didn't need to do anything…

Subject Access Request to solicitors
Anyone had any experience of submitting a Subject Access Request to a solicitors firm to obtain documents in a deceased person's will file for any references to themselves? Is a document disclosed in full, with just the names and identifying particulars of 3rd parties redacted?

Lifetime Mortgage and Inheritance
My parents took out a lifetime mortgage on their property in 2007. When my mother passed away seven years ago she left half the property to my youngest stepsister though I’m not sure that the lenders were informed of the fact. My father passed away earlier this week and it appears he died intestate as we have yet to…

Simple Will
Will be 66 this year. Have no will, so figure I should write one. It'd be a pretty simple affair. I don't have any specific items to leave. No property. So it's basically cash in bank accounts. The vast majority of my money is in a SIPP, which as yet, has not been touched. I have filled in the beneficiaries form for that,…

Calculating IHT when two life interest trusts are involved
I am executor to my mother's will and currently have valued her free estate. She had a life interest in her husband's house which is now left to his descendants. I understand the total IHT bill will be split between her free estate and the trust proportionately and the NRB/RNRB will also be shared. Now I discover she had a…

Royal Mail lost IHT forms - next steps?
Hey all. I posted IHT forms via Royal Mail Tracked. After over 2 weeks, they have not been marked delivered. The last tracking was that it was in "North Midlands MC" Despite being a tracked service, RM have been extremely dismissive and unhelpful - they don't know where it is and assume it is lost. HMRC have not received…

SRA misfiling Wills -Has anyone's been found?
Has anyone heard of the solicitors regulation authority (SRA) filing a Will incorrectly and finding it at a later date? On the death of a loved one, I went to the solicitor who wrote the Will to find that the practice no longer existed. I later discovered that SRA had intervened in the practice several years previously,…

IHT forms - what I've learned...
in case it helps anyone else:1) you need to use the Adobe pdf software. if you do then the autocalculations within the IHT400 works and (despite what it says on gov.uk) you CAN save a part completed form. You still need to manually copy info across from the schedules. If any figure is negative the box will stay blank. 2)…
