Oasis airline in liquidation- what to do?

    just found out that john lewis credit cards are run by hfc now household bank. they went bust for miselling insurance and had to compensate customers. then they were bought over by hsbc.

    after seeing all the problems here about getting a refund from hsbc cc holders, now it is obvious why my john lewis card was behaving as it is which we all know is not like john lewis because they never quibble about returns.

    well, i have written and given them 7 days notice to pay up. i know they wont which case i will fill in the form on www.moneyclaimonline.gov.uk
    to take things the next stage i.e.county court.

    my advice, dont bother with the ombudsman. move things along with HM website i've given above. they have 19days to respond to the filing of court papers as to pay or dispute. we will have our day in court with these non paying ccc.

    so for all those hsbc cc holders like me via john lewis, enough is enough. if we all file with moneyclaimonline they will buckle. it's the law

    Hi,

    For those Morgan Stanley cardholders out there, what address did you use when you claimed?

    I called Goldfish up a few weeks ago and asked for the address of the dispute team, and I was given the general PO Box customer enquiry address. Is this the address that you use too?

    Now knowing that MS/GF is owned by Barclays, do you recommend me to contact Barclays instead if it is a first time communication? If so, would someone provide an address for writing please?

    I wrote to the section 75 of MS:
    Goldfish, Section 75, PO Box 6, Glasgow, G68 9ZB.

    My claim got there within 24 hours of posting, as I had a phone call asking for "ABTA/ATOL bonded letter".

    I directed my complaint to Barclays:
    Customer Relations
    Barclays Bank PLC
    1 Churchill Place
    FREEPOST
    RTLA-CSUE-TCHC
    London
    E14 5HP

    I received my letter of acknowledgement from Barclays after a few days.

    Told that my claim is being processed!!!

    Go straight to the Financial Ombudsman. Don't mess about communicating with MS/Goldfish. Phone immediately and he will sort it for you. You'll get a friendly letter and leaflet telling you what to do if MS/Goldfish don't play ball, but they will. If you have inclusive minutes, it shouldn't cost you a penny. You can follow this route and take the court option outlined above. The call will take less than 10 minutes and is the obvious first step so I really would advise everyone involved in this to start with this move.

    Thanks for the info. I just rang the Financial Ombudsman, and the lady told me that I must file a claim first in writing to MS/Goldfish, stating that I am making a claim under section 75 of the consumer credit act. She said that if they decline the claim i will need to appeal. And if the appeal is declined, then and only then will the Financial Ombudsman step in, at the very last stage.

    Can I ask how you got the Financial Ombudsman to sort it for you?

    By all means complain to the FO about the way you are being dealt with by your Credit Card company.

    BUT the FO is not the quickest/easiest way to get your money back.

    Write to the Card company detailing your claim, stating that they are liable under Sect 75 of the CCA. Give them a fixed period to carry out the refund - 14 days ?
    Tell them if you do do not have the refund by then you will take action in the County Court. Remind them that your Court costs will be added to the amount your are claiming.

    Yes, of course I wrote to MS/Goldfish first using the address given on the front of the statement. I had already used the same card to buy replacement flights. I sent printouts of both return flights and evidence that Oasis had gone bust. I simply told them that they were liable to pay for my new flights and if they didn't cough up, I'd take legal action. They messed me about so I filed an official complaint with the FO. They paid up within a week.

    I called this morning, asking for an update, but the said they needed a oasis 'confirmation letter' from oasis that thers no chance of them refunding my money at all. I replied to say i wanted a final reposnse in writing and if theres no refund within 10 days, i will take them to the county court.

    have I done the right thing?? I am so fed up now .. just want the money back.
