Oasis airline in liquidation- what to do?

We've been made an offer by HSBC. They've refunded the original cost of the flights, and they've offered to refund 50% of the money we claimed for the replacement flights. They justify this by saying "under the provisions of section 75, the bank would only be liable to reimburse you for your own ticket and not the additional ticket purchased."
I'm in two minds about this.
Firstly, I don't like being treated like an idiot - I know that they are liable to pay for both flights - the claim under section 75 is a "like claim" for damages as the customer would have had against the supplier. There is no principle of contract law that says that damages are not recoverable for breach becuase the person who paid the consideration for the contract was not receiving the entire benefit of the transaction. That they are still telling lies makes me furious!
On the other hand, I honestly didn't think that they were going to pay up anything, and I had resolved that I was not going to take court action against them for the sake of what was £300.
Any thoughts? Has anyone else been made an offer like this?
Can we give HSBC a negative rating on the tally because of their sneaky, underhanded tactics?0 -

I also claimed from HSBC, but only for original costs as my other flights were actually cheaper > those of oasis. After I wrote them the letter on monday about that I wanted the refund asap, they called back saying it should be resolved soon and if the latest should be my flight date in 2 weeks time for a refund and I will not be charged any interest on it.
Anyways, for a full refund it has taken XX calls for the past 6 weeks and 3-4 angry letters to their dispute department.So give them 1 (just cos they pay up)!!
learnt something though, HSBC is not to be trusted... so I am in the process of changing my main bank accounts at the moment.

This morning i've been credited. This is despite sending no letters and purely over the phone contact. Think you just need an operator willing to help, sweet talk them a bit.

Hiya, I'm still having problems with Halifax Mastercard credit card. They don't reply my letters at all ( I have quoted the s75 etc) :mad: :mad: . Anything more I should do to make them reply??? Thanks a lots.0

You have two options.
If you call the financial ombudsman and explain the situation to them, they will probably offer to write a letter to the bank asking why they have not responded to you. This may have more effect than another letter from you.
The second action send a "letter before action" - that is, to threaten to commence a claim in the county court against them. This letter should state that if they do not pay you within [14] days, you will file an action in the county court. it will add weight if you attach a form n1 (which can be downloaded from the HM courts website) and a statement of claim setting out the facts of your case. Don't forget to claim your costs an interest. Note - if you go down this route - you should be prepared to go through with your claim.0 -

I have been following this thread right from the start and I'd like to offer my thanks to all who have contributed with helpful advice.
I have been patiently waiting for action from Barclaycard in response to my claim and having heard nothing further from them for the last three weeks, I decided to phone them this morning to query what progress was being made.
Basically I was informed that they were waiting for a statement from the liquidators before issuing any chargebacks against Oasis.
I mentioned that numerous people had already received refunds from their credit card issuers, including Barclaycard customers.
I was then asked if I had submitted a claim to Oasis or KPMG.
When I responded that I had indeed submitted a Passenger Registration of Claim Form and received an Acknowledgement of Receipt from Oasis, (this was since lodging the dispute with Barclaycard), I was asked to forward copies of these documents to Barclaycard and upon receipt, they will immediately issue the chargeback and refund my account.
It will take a few days for the documents to reach them, but here's hoping that my refund will happen fairly quickly now.
My advice to anyone else still waiting for action, is to submit the online claim form to Oasis if you haven't already done so, and then forward a copy of it together with the acknowledgement of receipt, to your card issuer. It might be all they need to finalise your dispute without having to threaten action from the Financial Ombudsman or County Courts.
I'll update here in a week or so when (if) I get my refund.0 -

Has any body got experience with MBNA in this matter?
Has any one been refunded by MBNA.
They have told us that we will not be refunded until our flight date
has passed, which in our case is October!
If anybody has had any better experience with MBNA I would like to know.

Hi, here is an update with my refund with MS/ Goldfish:
Last Wednesday i sent a letter to MS/ Goldfish demanding my money back under CCA section 75, threat of county court, etc as advised by members of this thread.
2 days later, i got a call from MS/ Goldfish stating that they had received my letter, and that I have to wait until the flight date has passed (in my case August) before they can issue a refund, as there is a possibility that the flight may still take place if Oasis is taken over, which is fair enough i think. They said they have my file on the system now, and will automatically refund after the flight date has passed no problem.
So i will check in August for a refund..
And thanks to everyone in this forum for their help!
Good luck to everyone trying to get their money back, don't get fobbed off like i was when i initially called up!
