Odd that HSBC is still bias to customers in hong kong, because HSBC and its subsidiary Hang Seng Bank have fully refunded their cc customers in hong kong and they dont have to because they have no S.75 or any consumer credit legislation in hong kong!! they did it for PR reasons. So, why dont they do it here.
Capitalone gave a refund almost instantly - they have now also compensated me for my rebooking of flights on other airline. Minimal digging required, had to ring a few times but they agreed on the phone, and only then had to send letters as proof. They even let me book the replacement ticket on a different card (amex for cashback) 5!0 -
The liquidators have made a press release that answer the questions that the banks have been asking of us ie. Will there be any money? (States it's still early to tell, but also says the company is insolvent and has significant shortfall of assets against liabilities); Is the airline bonded? etc.

Update that John lewis has finally paid only after i threaten them with a county court claim in a letter posted on monday. however, my request for damages/compensation for rebooking like lloyds tsb was conveniently not mentioned in their apologetic letter. hey, better than nothing but will press them for the damages.
so for all those uncoperative ccc, you guys&girls must now start writing a letter saying that you are giving them 7 days notice to pay and you will pursue your claim in the county courts. i think ombudsman is fine but county court is far more effective threat.
now, jlfs is upgraded to a 3 star from 0.
Dont waste time being fobbed off any more. you've given them enough chances. now start writing your "final notice" letter and also tell them all court charges will be added to your claim plus expenses like taxi, time off work etc.

Thank you for all the contribution to this forum and all the helpful tips ; I finally got refund from M& S after a shaky start. But the lady insist they are temporary awaiting approval from main Mastercard. They did credit the amount to my account.
She said because we were in HK when Oasis gone into liquidation and we had no choice but to take Cathay Pacific to Paris then Eurostar to London ( only way to be back ) in April. Not to mention all the inconvenience to transfer with two children in tow.
The refund only cover my returned part of Oasis . She said we have to wait for the Mastercard approval then I can go ahead with the claim of the extra cost. Is that true ???
I know I am entitle to claim and the lady actually phone me to let me know the procedure.

I have been following this thread with interest and am grateful for the advice received. I purchased flights totaling a little over £1,500 back in December for travel this July. I made a claim with my credit card company (RBS Mint) quoting the consumer credit act, as soon as I heard the news about the liquidation. After initially saying I had to make a claim with the liquidators and to see if I can get a refund, I stood my ground with them and after a few telephone calls and faxes received a full refund yesterday. Once I finally got through to the right person (always try to get to the decision makers by holding your ground and staying firm - remember he who talks first loses!) the refund was done whilst I was on the phone. From my understanding and my dealings with Mint it seems that they try to push you down the avenue of claiming back from MasterCard or Visa rather than from them. If this is the case then all the boxes have to be ticked (i.e "has the customer attempted to obtain a refund from the supplier") and will take a lot longer. Just keep quoting the CCA and you will get your refund. The first guy I spoke to said "..but we have to get the money back from MasterCard!" and as I replied "I'm afraid that's not my problem, my claim is against RBS mint and I want a full refund or I will commence legal proceedings". Believe me whoever your card provider is , stick to your guns and you will get your refund. I should also point out that Mint confirmed that I can also make a seperate claim for the difference in flight costs with BA (about £800) and this will also be dealt with "swiftly" under the CCA. I have the contact details of a key decision maker in RBS Mint Retail Disputes department, if anyone is interested mail me.
Quick update:
Have now received a full refund for the difference in price of my new replacement flights with BA and the original Oasis flights (approx £900) from RBS Mint.0 -
I have received a written offer from Goldfish for the full replacement tickets, so I am happy. Things started moving rapidly for me after I wrote to the chief exec of Barclays. Previous letter to the ceo of Goldfish did absolutely nothing. I hope he gets the sack in the reorganisation. As for the score, I will only give them a 3 at best because of all the !!!!!!!! they gave me on the phone to start with. I shall sign off now and only watch as a by-stander from now on, good luck to all of you and thanks again for those who offered advice.0

Seems like the ccc are now paying up. dont forget to ask for compensation/damages . it seems they follow up after paying the original ticket first and not all together at once but 2 seperate payments.0
