Many thanks for replying, Amy. I emailed HSBC's Chargebacks Dept: "chargebacksgsc@hsbc.co.in" with the liquidator's (KPMG) announcement to customers from the Oasis website dated 14 May 2008 both today and yesterday. I am not sure of what else they need so I will just have to wait and see. The problem I have is that I didn't even get any tickets from Oasis (as I suspect they must have known on 5 April that they were going into liquidation but HSBC still debited my account on 8 April, the day before Oasis went bust(!). HSBC have had to take my word as to the dates and times of my flights but their process and customer service is ridiculous.

If you want to fax HSBC, then I would suggest going via your local branch as they don't give out the fax numbers (which is what I did). I wouldn't bother with faxing KMPG via the Oasis fax because it won't work (I have tried numerous times previously and basically you end up redialling forever until your fax machine gives up).

No i have their fax number to their department. They gave it to me! I faxed them the announcement yesterday. I just have to wait and see what they do now....
Did you not receive a confirmation of flights email from Oasis with flight information? Surely Oasis charging you is a proof of having brought the flights.

I never received any flight itineraries/e-tickets from Oasis after booking my flight. I was fortunate enough to take down the flight details and the online booking confirmation number (which I consider a breach of contract). As you say, since Oasis charged me a few days later, this is a proof that I was supposed to be paying for a service which I did not receive.

I wonder if you or anyone else has had any personal correspondence from KMPG (receipts or public announcements excepted).

At present, apart from waiting, I won't be able to involve the Financial Ombudsman until 9 June or else will have to wait until the flights I originally booked have expired(!)

Luckily you wrote down the confirmation number, which is proof. As that will help with your correspondance with the liquidators!

I emailed them but have never had a reponse, luckily they put that announcement on their website. I think they were probably getting fed up of everyone asking the same thing.

Hsbc never said anything about waiting until the flights have expired..unless that is their next tactic in delaying my claim! Then I will be extremely annoyed, because a few people have already claimed back from HSBC.

It is obvious to us that your ccc is taking you guys for a run around and in a way bullying you guys or insulting your intelligence.Your ccc must be having a good laugh at us all, fooling us. Well, wipe the smile off their faces and issue a court warrant on them!!

Just write a final notice letter giving them 7 days notice and tell them it is they who are in breach of contract. Enough is enough, dont be nice to them anymore. I also got fed up with john lewis. they ignored several letters until the one i wrote giving them 7 days to pay up. And they did!!

Get writing and dont waste your time anymore. it is like watching you guys squeezing blood out of a stone. In court, if you prove to the court that they wasted your time, you can ask for compensation too.

Remember if they let your claim go to court, where you are guaranteed to win, their legal representation bill will be several times what your claim is. so do you think they will let you start court proceedings when they have no chance of winning.

DELAY NO MORE AND GET YOUR MONEY BACK LIKE THE REST OF US DID!!

Hi

If to start - one makes a certain amount of progress in that the CC company decides to investigate your dispute. The 1974 act would allow one at least to get this far - so far so good.

But thereafter there would appear to be nothing in this or anything else stopping the ccc from making it a long winded protracted affair.

Is there some legal text at this point which we can refer to and that legally allows us to Say to the credit card company " Sorry Oasis is your problem now - give me my money"

Surely telling the ccc that one doesn't have to wait until ones flight date has passed is your word against thiers? A legal point in support of the customer at this juncture will probably get myself and a lot of others out of trouble.

Lord Walker said in OFT v. lloyds tsb et al;

"
The creditor is in a better position than the debtor, in a question with a
foreign supplier, to obtain redress. It is not to be assumed that the
creditor will always get his money back. But, if he does not, the loss
must lie with him as he has the broader back."

" He is in a better position, if redress is not readily obtainable, to spread the cost. He is in a better position to argue for sanctions against a supplier who is not reliable."

So basically, they should shoulder the losses and we shouldnt be messed around.
Dont be soft with the ccc be firm and sue them in county court as ombudsman takes too long. it coming to 2 months of fobbing off, when do you say enough is enough, 10, 12, 15 or 24 months. dont forget you have a 120 days time limit.

dont bother with their excuses, say to their dispute department what Lord Walker said and then say i will issue a summons in court.

Hi,

Im new to money saving experts. Im basically in the same situation as a lot of people. I booked a flight with OHK to fly out in July and paid by Visa through Halifax. I conacted Halifax and they adviced that I had to go through KPMG. I have filled in the claims form for KPMG but I have been told by so many people that it is actually the responsiblity of the bank. 2 weeks ago I wrote another letter to Halifax saying it was their responsibilty to refund my money.

Any advice of what to do next?? Im not very good in these sort of situations

Hey JCT, go into one of their braches- actually spk to someone and explain that u are fully aware taht the avenue that u nee dto go down is visa charge back which is done via them (since u paid w/ ur halifax visa debit card) through a claim form calle d"non fraudulent atm/ debit transaction".
Be warned it's pretty rare taht teh staff know abt the scheme so might be worse printing out some info from earlier in this thread (i think try page 5 of this thread)
They fill the form on the computer in branch and ask for a copy for ur records b4 they email it off and it takes abt 2 wks to process.
It worked for me...just make sure you do it soon as you only have 120 days from knowing a company's got bust to get this processed, and by my counts, you've lost ~40 days already.
Make sure you keep uup on things and dont let them foib you off.
Good luck.
