Thanks for the advice on going into the bank. Unfortunatley they wernt very helpful. I insisted that there is a form that they can fill in for me and send off to the credit card department but they said it wasn't anything to do with them. They rang the credit card department on my behalf and they gave me the number of the liquidators!! I said I hadn't heard from KPMG and it would be unlikely I will get any money back from them. I also added that it is actually their responsibility!! Im going to write a very angry letter......anything else you think I can do??

Hmm, you did specify the form that they need to fill in right? (Non fraudulent debit/ ATM transactionn form)... alternatively call their debit card line and they put you through to the right dept hopefully and tehn you'll fill in your form over the phone. failing that i say try another branch where hopefully there will be more competent/ up to date staff.
[if it was halifax credit card- the situationn should be much more simpler o sort out since the visa credit card refund seems more straightforward inn general.]

i paid the ticket with my Hang Seng bank MC in Hong Kong and it's kind of complicated now.
the bank said they will investigate the problem when i reported the case in April and a guy from the disput department of the bank said he will hold the payment. hence, the balance will become zero in my statement in May.
after a month when i received the bank statement, the payment still reamined there and I now need to pay for the late payment as well! i immediately talked to the same guy and he said he will manually change and this is wht he did:

Although I dun need to pay for it, the amount is still being shown on my bank statement from now on which makes me worry! the guy refused to set the outstanding balance to become zero and refused to write me a letter mentioning about the whole thing. I m worried that i might need to pay for it eventually!!! perhaps i should restate the term of the 'recharge' as O8 is no longer able to provide the service? (which i already did in the first place)
any advice regarding the case or anyone else with the similar situation? i m so confused now.

just a heads up re financial ombudsman.
the cc (post office) refunded the tix, however, they wouldn't refund the difference of having to buy new tix (my folks were stuck out in HK when Oasis went belly up).
my folks contacted the financial ombudsman, and their view was that the cc didn't have to pay the difference.

I am going to write them another letter again next week! I think you should do the same. I've written to MBNA 3 times and spoken to them many times. I logged a complaint with the Financial Ombudsman w/c 12/05 and also spoke to one of the managers at MBNA. Got a final letter from MBNA replying to Financial Ombudsman's request saying that i wont be able to claim anything till after my travel dates, which are in Aug and Sep. They even quoted that they had been advised by Visa not to pay out since Oasis had not yet annouced official liquidation. The same letters that I've sent to MBNA have also been sent to Halifax by my sister (she booked with Halifax) and she been told today that she'll get the money back plus differences! Are they just bluffing (since it's stated in black and white in their letter) or have they got right not to refund till travel dates are pass?!
Seems like MBNA are in the minority - I've challenged them on this but they said they were doing nothing wrong; maybe other banks just too keen to pay out!0 -

KPMG's Edward Middleton and Patrick Cowley were this morning appointed Provisional Liquidators of Oasis Hong Kong Airlines Limited and Oasis Growth and Income Investments Limited by Order of the High Court of the Hong Kong Special Administrative Region on a winding-up petition presented by the two companies.
Having only been appointed a very short while ago, the Provisional Liquidators are working to assess the companies' financial and operating situations.
However, the Provisional Liquidators regret that one immediate consequence of this appointment is that all of Oasis's scheduled flights are now cancelled.
Only a liquidator can cancel flights,sack staffs and sell planes. kpmg couldnt have been able to do all this without hk high court jurisdiction giving them powers to do so.
just write another letter to your ccc giving them 7 days to pay and then tell them you will pursue your claim in county court. you have the law on your side and they wouldnt want to spent money on legal representation in court which will end up costing them more than your tickets.0 -
Just to remind fellow victims that if your ccc gives you wrong advise about your claim which resulted in them delaying payment to you, you can claim damages for this too, thru the county courts or with the financial ombudsman - depending the process you choose.0

I am sorry to hear that u paid with your MBNA card as well! I am very angry with them! :mad: I have stopped using their credit card completely! I won't use their service ever again! I wonder if we should pay off the balance still? Of course no one would feel like paying it off. But they really should waive our interest as well!

I wrote to visa and they replied more or less that they had nothing to with
it. see page 28/29 i think. They said they don't have individual durisdiction over individual cases but here they have intravened directly.
So they did direct MBNA here.
Did they just write to MBNA and no other bank?
MBNA seemed the be the worst in the whole Oasis collapse.
So Why do they prolong it when so many have paid out?
Its probably the fact that they have no bricks and mortars branches.
They are completly faceless.You don't get to get the chance to give them busy lunch time abuse inbranch as advocated on this thread.
If one never gets a penny back from them it probably tells us more about
about MBNA bank;
MBNA are unreliable. Don't buy products or services with MBNA credit card.You will get better afterservice elsewhere if there are problems.

Thier is a weight of evidence against them in favour of Consumers act 1995 and OFT v, LLyods TSB so they must have taken a deceision to call individual customers bluff no matter what legal threats they get.
Its not nice to go to court. But you may not have any other option.0
