Oasis airline in liquidation- what to do?

Hi everyone, I too have been caught up in the whole Oasis fiasco - paid with Halifax Credit Card - been going back and forth with them. (I flew out with Oasis and they went into liquidation while I was in HK). My question is can I claim for the WHOLE amount paid for tickets or only the return cost of the journey? I know a lot of people have received a full refund/credit but when I mentioned this to the lady in the dispute department, all she said was "I can't account for what other banks do".

AFTER a long long long wait....we finally got our money back....well I still have to check the statement to see that they have actually credited the account. But that is what they have told me..So i am now relieved.
They said they will call me when there was further news, but they didn't. I had to chase them up...so HSBC are rubbish.0 -
John Lewis had said that they are not liable to pay for rebooking unless i was abroad while ohk went bust. there is no logic to this argument and in a way agree that they are liable in some way. so i will pursue them with litigation.
lloyds tsb has asked for documents for my new bookings and the cost/invoice. so i assume they may compensate me or else why ask for all these documents? we will see if they will pay the extra cost over my original ohk fare.
so, for all you guys/girls, do pursue your ccc for the extra cost over your original fare for rebooking. at least lloyds may consider compensation while JL say they wont but we will let the court decide.
do it soon because they all now have to go thru the same again with their customers who had bought silverjet tickets!!0 -

You can only claim the returned part of tickets .
I was in the same situation and M&S refund the unused part of tickets. Now I am hoping to claim the extra cost ( with CX) to return London.

I had paid for three oasis tickets just two days before its announcement of liquidation. I have subsequently sought confirmation from Visa International that its debit card holders can request refund from issuing banks. So I then contacted Halifax's card centre several times, and got a full refund after about four weeks. Must add that staff in the branches as well as the card centre are not aware of debit card holders' rights. I had to explain, be persistent and assertive to get my money back. The customer services team has been very helpful though, relating messages between myself and the subject officer(s) (Link & Debit Department) who had refused to talk to me direct.
I also want to mention that BBC's Working Lunch programme had also recently featured similar incidents stating debit card users can get refunds.

there is a phone line where you can get help in filling in the forms and they will then do the rest.
court fees are according to your claim amount. for example, over £1000 it is £70 i think. below £500 would be half that.cant remember exactly but it's on their website.
All court fees are refundable from your CCC just add it to your court papers.
Once you have filed, they will write to your ccc about the impending case and will then give your ccc 19 days to respond as to whether to pay or contest your claim in court.
if the latter, the agency will choose a county court near you.
i doubt it if your ccc will go to that length. remember all miscellaneous expenses can be claimed. like baby sitting, taxi or train fares etc.
your ccc is obviously not your local bank with a call centre in india!!
one can complain to the advertising board as well as breaking the law for s.75

Having just phoned HSBC on their Disputes Department line and spoken to a Supervisor (who happens to be Indian! - nothing against her personally but their call centre seems to be in India!), it now turns out that my old credit card (which was cancelled due to HSBC's anti-fraud protection measures!) was credited with my Oasis refund last Friday, 30 May after 5 working days. She has just credited my new credit card instead(!) and refunded me with the interest charged because I went into the red on their part.
I'll believe it when I see it, but hopefully my refund will be in my account tomorrow, so watch this space.0 -

For a few minutes to your time and first class postage, type a letter reminding them that as your ccc was in breach of contract, you are entitled to additional cost for repurchasing new tickets with another airline.
they will not outrightly say they are not liable to pay compensation for damages because it would be seen as wrongful advise by the ombudsman or courts and will result in them paying more damages.
they are hoping that we wont pursue them for it since we are relieved to get our oasis cost back from them and will give up fighting for damages.
well, dont let them get away with it and just write a polite letter reminding them that they are liable for such additional cost since they are in breach of fiduciary contract.

I wrote to Goldfish for a refund relatively later than most people did (2-3 weeks ago). In addition to the standard stuff, I also highlighted (i) the second notice KMPG issued on 14 May (ii) my willingness to give them back the refund if eventually Oasis has enough assets to compensate me and (iii) the research I did on the net e.g. this forum which indicated that many card companies have started to pay up.
It took them a week to acknowledge me, but when they did I was told immediately that they would give me back the money. My only dissatisfaction is that they could not issue me a cheque and insisted on putting the money back to my credit card account. After a bit over a week the money is finally there today.
I guess I had a smooth ride because (i) by the time I first wrote to them they had already fully understood the general situation and the number of people affected and (ii) the flight date has passed.
I wish those who are still waiting a happy ending. I believe that every credit card company will eventually pay up and it is just a matter of time.0 -
I am currently chasing MBNA and have been getting the same story ie. they will not consider refunding the cost of my two tickets and the difference in price between Oasis and replacement BA flights until after the "service" date has passed ie. the date of my outbound flights. I have provided them with all necessary evidence and information, and also got the Financial Ombudsman to write to them, with no success in changing their minds.
It appears that their Billing Disputes team will refund the price of the Oasis tickets and their Section 75 Team will refund the price difference - I'm not hopeful of a swift and happy resolution, I must say.0 -
We paid for Oasis flights with John Lewis credit card and were stranded in Hongkong when Oasis went under. Cathay and BA issued various bogus offers to get stranded passengers back. Cathay's best offer was to get us to Paris; find your own way home from there. BA's best offer was flights via Shanghai or Peking; the catch was that we would have had to get mainland China visas AND pay for an overnight hotel stay. We rejected these and used John Lewis credit card to pay for Qatar flights via Doha; approximately twice original Oasis cost.
On return we consulted this site and Consumer Direct (who were also very helpful). Wrote to John Lewis on 4 May with all evidence and Section 75 arguments as advised. Checked with John Lewis this morning and was told that full cost of Qatar flights had been credited to my account on 19 May. Looking forward to next statement!!
