  • What we were waiting for - from the KPMG China website:

    "Hong Kong, 11 June 2008

The Provisional Liquidators of Oasis Hong Kong Airlines Limited, KPMG's Edward Middleton and Patrick Cowley, confirm that the High Court of the Hong Kong Special Administrative Region today ordered that Oasis be wound up. The Court was satisfied that Oasis is insolvent and it was in the best interest of Oasis and its creditors that Oasis be wound up. Oasis has liabilities in excess of HK$1 billion, including some 22,000 passenger claims expected to reach in the region of HK$250 million."

At last - I can now threaten MBNA with court proceedings .... no need to wait for service dates anymore

    Silverjet is back in business.

According to the BBC website, its honouring existing customer tickets.

    Cheers,
    karen

unfortunately it's probably going to be more of a hindrance for those trying to recover their money from the credit card companies......from Silverjets site

    To our dear customers,
When our inaugural flight took off in January 2007, we pledged to change the face of air travel. Your appreciation of our unique values and your belief in our product has allowed us to achieve this.
Your belief in us was shared by our investors - but regrettably, due to unforeseen circumstances, they were unable to unlock the finance that we needed. As a result, we are very sad to announce that from 30 May 2008, we will cease operations and we are no longer able to honour flight reservations.
We extend our sincerest apologies to those of you who have travel plans with Silverjet in the future and at present. You are advised to seek alternative travel arrangements with other carriers, and contact your credit card company or travel agent directly for information on obtaining refunds*. "
so if you now have made alternative arrangements, the credit card companies are going to try and squeeze people .....i'm included in this !
as far as i'm concerned the breach of contract occurred when they issued the above release....however i'm not a lawyer.
will have to see if they get regulatory approval and whether they don't have cold feet before friday.
after going into administration it's hard to see if the business is viable.
if 10000 people were affected by this (according to news sources) and an unknown percentage will have already booked alternatives ....where are the passengers going to come from ?
i recommended them to people who booked and would have probably used them for 90% of my leisure flights to the US east coast.....unfortunately they have lost me (along with countless others) ....it's back to BA Club or Virgin UC for the future.

    anyone else with views ?

Finally got my HSBC Credit Card refunded today (i've checked and it's credited). Took about 2 months for me. Admittedly I didn't have much hassle. All I did was send them a letter to the chargeback department quoting the Consumer Act. About 3 weeks later got form SNR 3 to declare didn't receive service. Sent this back. Called up last Thursday and the indian call centre guy made excuse that their system was down so couldn't anything but promise to credit me by a week. And there you go credited in exactly a week. Yey finally sorted
  • I have now received my refund from Barclaycard for 2 tickets (due to fly Oct). Total time taken was 6 weeks. Didn't have to push them, just wait patiently. Would still only score them 3 out of 5 though, as my friend got his refund in less than 3 weeks from Capital One.

Thanks again to all the posters who have provided some very useful information. Luckily I didn't need to use it to get my money back.

Neither have I  I have just written a letter to them and will be posting it on Monday. I have mentioned about the recent court hearing in case they are not aware of it  I also mentioned that if they do not refund me asap, I will go to the Small Claim Court!

MBNA is the worst bank ever!

Dont forget to mention that you will be seeking punitive damages from them in your letter that you might incur, such as postage, court fees, time off work, child minder, taxi or train fare etc, etc..... anything that you had incurred as a result of litigation.
Most importantly, say you will seek compensation for wrongful advise/procedures they had quoted to you like flight date has pass and nonsense about mastercard procedures, say £250 or so.

all thess excuses they quoted you has nothing to do will the law of this land. mastercard procedures does not ride above any law of this country!! they have beed given a banking liscence and by accepting it they agreed to operate under the rules and law of UK .And obviously, they are disrepspectful of the law and think they are above the law.

    good luck guys!

I've sent MBNA a letter last week after the liquidation announcement. Got a call from them today and asked me how did i know that they had gone into liquidation. She even told me it's 'strange' as she got more than one customers claiming such! Anyway, after explained to her how to search KPMG on google, what is KPMG, how to get to the news page of KPMG, what the term 'wound up' means (she didnt think it meant liquidation), and confirming with her colleague... she tended to agree with me that Oasis is now in liquidation... *sighs* But they cant make a decision yet as manager is off and they need to check so should hear from her again... she did say the s75 claim for extra would need to be handled by another team and would take them 10 days to response... I thought it would only be fair for me to warn her that I would take them to the court if her feedback is not positive... will let you guys know if hear anything...
